CITY OF MEDINA
RESOLUTION NO. 'X 2-0
RESOLUTION GRANTING FINAL
APPROVAL OF LOT COMBINATION
FOR HIGHWAY 18 & 55 PROPERTIES
WHEREAS, Highway 18 and 55 Properties, a Minnesota limited partnership,
(Applicant) has submitted an application which would allow the division of a portion
of the property generally referred to as the QX property (Parcel B) and its
combination with property owned by the Applicant and located immediately to the
south thereof (Parcel A); and
WHEREAS, the legal descriptions of the parcels are attached hereto on
Exhibit A; and
WHEREAS, the proposed division and recombination has been reviewed by
the planning commission and City Council for compliance with all City ordinances
and regulations pertaining to the subdivision of land.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the division and recombination of the above described
property is hereby approved, subject to the following:
1. Excess earth on the property will be redistributed or utilized;
2. Questions regarding present water retention, proper drainage, and hardships
associated with the QX property as a result of this division shall be
addressed by city staff;
3. The Applicant shall dedicate to the City the right-of-way for T.H. 55 and
the utility and drainage easements required by the city engineer;
4. The Applicant shall remove the current access from T.H. 55 and shall
landscape the area to prevent vehicular ingress or egress from T.H. 55;
5. Park dedication fees shall be waived;
6. The Applicant agrees and acknowledges that there will be no separate
development allowed on Parcel B and that any development of Parcel B shall
be in connection with Parcel A; and
7. The Applicant shall pay to the city for administrative expenses the amount
determined by the city staff to represent the actual cost to the City of
reviewing this application.
