OF TEMPLE CITY CITY COUNCIL MINUTES AUGUST 19, 1980 Mayor .Atkins called the regular meeting of the City Council to order at 7:32 p.m. on. Tuesday, August 19, 1980, in the Council Chamber of the .City Hall. 2. There was no invocation given. 3. The .Pledge .of Allegiance to the Flag was led by Mayor Atkins. 4 ROLL:. LOCAL' SUBDIVISION REVIEW COMMITTEE City Manager Koski .. presented; background information, stating the City,. has -been .handling'subdivisions with the Department of Los Angeles: County Regional Planning since 1960; it generally takes three to four ... weeks to hear the case before the County Subdivision Committee and ...another_three . to.four weeks to receive its recom- mendations,...,._.Pursuant :to State law, . applicants must be advised of the. local government ::_decision .on tentative tracts within 50 days from .the :time ..application . is submitted. By establishing a local Subdivision .Review Committee, .the review process could be expedited and also..have.better control and knowledge of the conditions to be proposed. Planning Commission, at their regular meeting held August 12, 1980,. reviewed the staff proposal and recommends City Council approve. Councilman .Gil.landers.. moved ..to establish local Subdivision Review Committee pursuant.ta staff memo dated August 14, 1980 and on file in the City - ...Clerk's office, seconded by Councilman Merritt and carried. 7. COMMUNICATIONS: A. Church Women United - Request to solicit funds for UNICEF October 31, 1980 . City Manager .Koski presented communication from Church Women United requesting permission to solicit funds for UNICEF October 31, 1980. Councilman Tyrell stated that he has gathered material relating to UNICEF, '.including ._some .statements printed in the Congressional Records and would `. like Council and Church Women United to read before action... is_. taken .on this. request.. Councilman Tyrell further ;stated the .same .request was granted last year because the majority of the Council ... felt the residents should make the choice as to whether to. donate; ,. however, he is not in favor of the solicitation and feels the philosophy of the organization is not consistent with that of the residents of Temple City. 1 Council Minutes, August 19, 1980 - Page "3 Councilman Tyrell moved to continue this matter to September 2, 1980, seconded by Councilman Merritt and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Gillander,si.. Ivanhoe Lounge.- Request:: for Change,in_Conditions of Operating City Manager Koski_presented._communication from Sammy Grande, owner /operator;.of..Ivanhoe.. Lounge, requesting permission to leave the rear door open: during the afternoon hours, to be closed during the time entertainment ._and - music °commences. Mr. Koski advised the closure of the rear door was a condition to a Conditional Use Permit granted by the Planning Commission. Councilman .Dennis moved to refer the matter to mission, seconded .by..Councilman.Gillanders and C. Request for.CityAssistance - Improvement (Private'Street),:-9600 and 9700 blocks the Planning Com- carried. of Woolley Street City .Manager Koski: presented: communication from residents of the 9600 and .9700:. blocks t.on_ Woolley Street, advising they have incurred considerable: damage :. due ::to.` broken . water lines, poor drainage, and lack 4of. maintenance:program... -They have requested help from the City '. in purs.uingsome..improvements. In order to. proceed in an orderly fashion;_staff:recoinmends: securing the professional services of Dwight: French:_who:_wouldprepare a brief report outlining the various :.procedural:requirements . and a current cost estimate. The report would. be.made:,.available: to. all the . property owners and a meeting held, ..after .,which, if there is a majority support for the improvements, ..the .final .petitioning process and implementation of an action plan would_ commence, including dedication of right -of -way. Councilman. Merritt._, moved to approve and authorize staff to engage the services of DwightuFrench, professional engineer, in the amount of $500, seconded.. by Councilman Gillanders and carried. 8 TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Hazel Holthous,.. Vice ..President, Church Women United, advised that ovations or:. NICEF this : year would be sent to East Africa which is in .need., of heavy _ equipment to produce water and food. She accepted the materials distributed by Councilman Tyrell and will attend the. September 2 Council meeting, RECESS: T0: CRA..:. A. City Manager: Vacaton:'Leave'- September 12 -26, 1980 Councilman Tyrell moved. to authorize City Manager vacation from September 12 -26, 1980,: seconded by Councilman Gillanders and carried. B. Modification of Zone Variance Case No. 79- 565, 9094 E. Las Tunas City Manager_ Koski_ presented- background information, stating the Planning. Commission, _, at.. their regular meeting held August 12, 1980, approved :.. a_request:fore modification of Zone Variance 79 -565. The original request for :a. -zone: variance was granted for an inventory storage in .a .0 -2 zone (first permitted in the M -1 Zone) , reduced rear yard: setback, and reduced- number of parking spaces. Applicant, .. earlier.: this :.year,,submitted a request for modification of the zone - variance. to. construct a two -story structure with less parking spaces: than originally granted and request was denied. Applicant: appeaied:..the,denial to City Council and at applicant's request the .matter .was postponed to the City Council meeting to be held. September_ -2... Subsequently, a.new.modification. was submitted to the Planning Commission .and '.approved : with a request that the matter be brought to the City. Council for review. Councilman Tyrell..expressed:concern that the first request for modification ..reduced.the.parking. spaces from 31 to 28, and now their request is to reduce it .further to 24. He felt there should be a full Environmental.- Impact. Report. Councilman Merritt disagreed;,stating -he. doesn't see any problem; the area .. surrounding- is multiple .. residential; the property is unique the usage does not_require:a. lot of parking spaces; and other uses have_been granted less than required parking spaces. Councilman Dennis:. stated his.concerns that the Building and Fire Department _have.cited:_.problems -that could arise, and whether an Environmental Impact _Report would solve that problem he is not certain, :however.he_would_prefer that ..a full EIR be submitted. Councilman .Gillanders .stated.he. would . want to see an EIR that Will address each and every issue, including what is to be stored and what the impact will be on the neighboring community. Mayor .- Atkins ...expressed:concern.. the applicant has submitted three separate ..configurations;..he shares. Councilman Dennis' concern about .access and .fire protection; and he would want a full EIR Report before considering_ the matter. Councilman ..Tyrell::moved.. to_ appeal the Modification of Zone Variance, Case :..No. ..79 -565 _.ands_ set a tentative date of October 5, 1980, seconded by .Councilman Dennis and carried, Councilman Merritt noting his. objections. C. Councilman: Me±ritt.stated_that.recently a six -unit condominium prof ect._was submitted:. twice: and.. the. nit picking regarding a minor variance was most '!.arritating:to -him. Now in the same location a four ..unit ..apartment _ is being built and they don't have to apply for any special .. conditions and .he• resents this type of thing. D. Councilman Tyrell stated that in reading the August 5 minutes he agrees with Mrs. Grant that consideration should be given to 1 Council Minutes, August 19, 1980 - Page 5 providing more conveniences in our malls; such as; benches, drinking fountains, shade, etc. Councilman Tyreli. also :_ commented .on: Underground .District No: 4, stating he feels. the City was not in a: position `to vote on this project until such time they had a firm commitment of the financial impact of the property. owners. City'. Manager Koski .'.. advised.staff.is working.. with Public Utilities Commission to'.change.RU1e•20. to allow Edison; to . expend funds on private property for underground conduit and cable so that the property owner only is responsible for hook up to their service panel. E. Mayor Atkins_ directed. Council's attention to the Jerry Lewis Muscular Dystrophy Telethon .. and communication asking him to assist on telephone, stating he would not be able to provide the help they seek .. but supports- this very worthwhile project. Mayor Atkins also . advised he had received 'a copy of resolution from the Sacramento: City. Council _ regarding the equal rights amend- ment and stating they .will : not attend a National League of Cities Congress of Cities conference in a state that has not ratified the Equal Rights Amendment9 Mayor. Atkins stated he had 'repared_ letters to the_ City's legislative representatives..in: response to the Attorney General's opinion it was the.. state.'s.:prerogative= to control the sale of fireworks, advising them it was the City's opinion the control of fireworks :should ..be a local option. 11.
