WI3EREAS, pursuant to t.he recommendation of t.he City Manager of the City of Lynwood, this City Council .has previously found t.hat certain premises, hereinafter more fu11y described, may be presently being.maintained in such a manner as to constitute a nuisance, W~3E.REAS, in Light of said finding, this Council adopted a resolution de- claring its intention to conduct a public hearing to ascertain whether a nuisance is being maintained on said property, and W~~EREAS, t.his Council has held a hearing and has .heard and considered all relevant evidence and testimony from all relevant evidence and testimony from al1 interested persons desiring to be .heard concerning t.he conditions constituting the alleged nuisance and the proposed rehabilitation, repair, removal, and demolition t.hereof, NOWs THEREFORE, the City Council of the City of Lynwood does .hereby find, determine, order and resolve as follows Section l. The property described as Lots 68, 69 Modjeska Park, and generally known as 2958 Oakwood Avenue, Lynwood, California, is hereby found and declared to be a Public Nuisance as defined in Chapter 21 of the Lynwood City Code, Section 2. T.he particular conditions of said property whic.h are here and found and determined to constitute a nuisance are described as follows 1. Accumulation of lawn mowers, lawn mower parts, miscellaneous equipment, materials and motors in front yard. ~ 2. Debris and rubbish scattered t.hroughout front yard. Section 3. It is further found and determined that, in order to abate said nuisance it will be necessary that t.he following steps be taken either l. (a) Remove a11 lawn mowers, lawn mower parts, miscellaneous equipment, materials, and rnotors from front yard. (b) Store any material or equipment in rear yard at least 18 inches off the ground. or• 2. Screen front yard with opaque fencing (wood or masonry) that con- forms to Cit~y Ordinance requirements, i. e., 6 feet maximum heig.ht, 6 ft. heights cannot go beyond the 20 foot front yard setback (see attached sketc.h) and as approved by the PLanning D~partment. and• 3. If the property owner fails to take either step as ~rovided in this resolution within thirty (30) days after the date, this resolution is posted upon the pro~erty, the City of Lynwood shall imxnediately cause the same to be abated by City personnel or private contract and suc.h personnel or persons under contract are e~p;ressly authorized to enter upon the premises for such purposes. Section 6. In the event the City of Lynwood causes the aforementioned nuisance to be abated by City personnel or private contract, the owner of the premises shall be liable to said City for all costs of such abatement, iacluding all storage and administrative costs. All said costs shall constitute a special assessment against the subject property and shall be recordec~=:~ ~ Section, `7. The City Clerk is authorized and directed to post conspicuously at least one copy of t.his resolution on the subject property and to send another copy of this resolution by registered or certified rnail, postage prepaid, return re- ceipt requested, to the owner of the land as .his nam.e and address appear -on the last equalized assessment roll or is known to the City C1erk. T.he failure of any owner or other person to receive such notice s.hall not affect in any manner t.he validity of any proceedings taken .hereunder.
