HomeMy Public PortalAbout2010.103 (05-18-10)RESOLUTION NO. 2010.103 A RESOWTION OF THE CITY OF LVNWOOD AUTHORIZING THE MAYOR TO EXECUTE A HOME PROGRAM RESERVATION AND COMMITMENT AGREEMENT ~ETWEEN THE CITY OF LYNWOOD AND THE FOUNDATION FOR AFFORDABLE B~iOUSING (FAH) TO DEV~LOP AFFORDABLE RENTAL UNITS AT PARK PLACE AND TO DESIGNATE FAH AS A CITY SELECTED CHDO WHEREAS, the City of Lynwood administers a Housing Rehabilitation Program pursuant HUD/HOME guidelines located at Title 24 CFR, Part 92; and WHEREAS, in accordance with HUD guidelines, the City of Lynwood is required to reserve and commit 1`5% of the annual allocation of its HOME funds to a qualified Communify Housing Development O,rganization (CHDO); and ' WHEREAS, The City of Lynwood proposes to enter into a HOME Program Reservation and Commitment Agreement with the Foundation for Affordable Housing, a qualified CHDO, to assist the City in carrying out the HOME requirements of providing affordable housing opportunities to low and very low income residents; and WHEREAS, The City proposes to, commit FY 2008 CHDO funds of $90,538 and FY 2009 funds of $101,173 for a`total of $~191,7'I1, to the Foundation for Affordable Housing. , . ', > ' , NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The Lynwood City Council approves the HOME Program Reservation and Commitment Agreement ("Agreement") with the Foundation for Affordable Housing, subject to the approval of the form of the agreement by the City attorney. The agreement will be contingent upon the approval of an appropriate amendment to the Disposition and Development Agreement between AMCAL and the Lynwood Redevelopment Agency #o authorize the use of HOME funds and impose appropriate conditions for the use of such funds. Section 2. The City hereby commits $191,711 of CHDO funds to the Foundation for Affordable Housing. Section 3. The above mentioned funds shail be used for fhe development of affordable housing pursuant to HUD/HOME regulations. Section 4. Mayor is hereby authorized to execute the agreement. Section 5.
