CITY OF MEDINA
RESOLUTION NO. CM. —
RESOLUTION AUTHORIZING REASSESSMENT
AND REFUND OF SPECIAL ASSESSMENTS
LEVIED IN REGARD TO TAMARACK DRIVE
IMPROVEMENTS (PROJECT NO. 87-2)
WHEREAS, the City of Medina (City) conducted a public improvement
project in 1988 and 1989 (Project) which resulted in paving Tamarack Drive from
County Road 24 to Blackfoot Trail; and
WHEREAS, pursuant to Minn. Stat., Chapter 429, the City assessed a portion
of the cost of the Project against benefitted properties; and
WHEREAS, Sheldon G. Coplin and Beverly Ann Coplin; Arthur Jubert and
Rita Jubert; and George Wessin (Owners) are owners of certain properties which
were assessed by the City for the Project; and
WHEREAS, the Owners challenged the City's assessment of their properties
as exceeding the benefit derived from the Project; and
WHEREAS, pursuant to arbitration, it has been determined that the
properties of the Owners received no benefit from the Project and should not have
been assessed therefore; and
WHEREAS, the City has received from the Owners $250 assessed against
them by Hennepin County district court judge Sean Rice for delay in pursuing their
claims regarding the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota as follows:
1. The City shall pay to Mr. George Wessin the sum of $487.55 as
reimbursement for payments made on the assessment for the Project. No
payment shall be made to the other Owners since no payments were made on
the assessment by such Owners.
2. The city clerk -treasurer is authorized and directed to take any and all
actions necessary to disburse such funds.
3. The special assessments due and owning from the Owners for the properties
specified in Exhibit A shall be reduced to $0 and the city clerk -treasurer
shall inform Hennepin county of such reassessment.
