RESOLUTION NO. 96-a
RESOLUTION GRANTING A
VARIANCE TO SCOTT DALLMAN
FOR 4602 WICHITA TRAIL
WHEREAS, Scott Dallman (Applicant) has requested a variance to install a
residential septic system which does not comply with the requirements of Section
720 et seq. of the Medina Code of Ordinances by failing to maintain a minimum
separation of 36 inches between mottled soil and the bottom of the treatment
system; and
WHEREAS, Section 721.03 of the City's Code of Ordinances require that
variances from the strict interpretation of the individual sewage treatment and
disposal systems ordinance be granted only when there is a demonstrated hardship
because of circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's request on
December 12, 1989, and recommended approval thereof; and
WHEREAS, the City Council has had an opportunity to review the matter
and to hear from the Applicant regarding his request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the Applicant's request for a variance is granted, subject to
the following conditions:
1. The Applicant shall install a system in compliance with the design outlined
in the letter to the Applicant from S-P Testing, Inc. dated October 13, 1989;
2. The trench shall be a minimum of 300 lineal feet or 900 square feet;

3. The Applicant shall pump the tanks in accordance with the recommendations
of S-P Testing, Inc. and shall maintain records thereof for city inspection;
4. If the Applicant expands the size of the existing house, he shall install low
water usage fixtures;
5. There may be a maximum of three bedrooms in the house;
6. The Applicant shall pay to the City a fee in the amount determined by city
staff to represent the cost to the City for reviewing the application; and
7. Any violation of the terms and conditions of this variance resolution or the
provisions of Section 720 et seq. of the Code of Ordinances shall be grounds
for revocation of this variance.
BE IT FURTHER RESOLVED that the variance hereby approved is justified
by the following circumstances which are unique to the property.
1. The property has disturbed soils and steep slopes in the areas appropriate for
septic systems, which precludes use of a mound septic system; and
2. The variance will alleviate a problem with an existing structure and septic
system and will not be used in connection with development on a vacant lot.
