CITY COUNCIL
MINUTES
SEPTEMBER 2, 1980
INITIATION:
1. CALL TO ORDER:
Mayor Atkins called the regular meeting of the City Council to
order at 7:32 p.m. on Tuesday, September 2, 1980, in the Council
Chamber of the City Hall.
2. The invocation was given by Dr. Marshall Ketchum, First United
Methodist Church, 5957 N. Golden West Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Atkins.
4. ROLL CALL:
Present: Councilmen- Dennis, Gillanders, Merritt, Tyrell, Atkins
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Planning Director Dragicevich,
Parks and Recreation Director Kobett, Julie Estrada,
Temple City Times
At this time Sid Munger, Manager, Temple City Branch, Automobile Club of
Southern California, presented on behalf of the American Automobile Asso-
ciation, a plaque recognizing Temple City's outstanding pedestrian safety
accomplishments for 1979, stating Temple City is the only southland city
and one of five nationally to receive the Award of Excellence, having
been in competition with 456 U. S. cities.
Mayor Atkins accepted the award on behalf of the City and thanked Mr.
Munger for the recognition, stating the award was possible because of the
effort and cooperation of the City, the Traffic Commission, the school
districts, and the Sheriff's Department.
5. CONSENT CALENDAR:
Councilman Tyrell moved to approve Items A through D as recommended,
seconded by Councilman Dennis and carried.
A. APPROVAL OF MINUTES - Regular Meeting of August 19, 1980
Approved as written.
B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of August 26, 1980
(1) PROPERTY NUISANCE CASE NO. 80 -56, 9649 LONGDEN AVENUE
Adopted Resolution No. 80 -1925 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A
PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF.
(2) PLANNING COMMISSION ACTION
Received and filed a memo relating to action taken by the Planning
Commission at their regular meeting held August 26, 1980.
C. RESOLUTION NO. 80 -1926: EMPLOYMENT OF PERSONNEL

UNFINISHED BUSINESS:
6. CHURCH WOMEN UNITED - REQUEST TO SOLICIT FOR UNICEF FUNDS -
October 31, 1980
This matter having been continued from the August 19, 1980 meeting
of the City Council, Mayor Atkins invited anyone wishing to speak
to come forward.
Hazel Holthaus, Vice - President, Church Women United, stated she
and other members had read over the material submitted at the last
City Council meeting and they would like to go ahead with their
application for permit to solicit, stating the need is great, the
monies are not collected with fraudulent intent, and that the
money always goes to children in needy countries, never within the
United States because UNICEF has no contract to work within our
country.
Dr. Marshall Ketchum, 5956 Golden West Avenue, stating he was
speaking as a citizen, thanked Council for the material provided;
Council must work within the framework of the Municipal Code, citing
Section 4604 which in essence states that if, after investigation,
the applicant has stated true facts or a fraud would not be per-
petrated on the public, a permit shall be issued.
Councilman Tyrell stated he had provided the material on UNICEF
which has been referred to; that he also believes the Council has
no choice but to approve the permit, however he did want those
supporting the program to understand his opposition to the program
but that he would vote to approve because he recognizes their right
to solicit.
Councilman Tyrell moved to approve request from Church Women United
to solicit for UNICEF funds, October 31, 1980.
Joyce Luna, UNICEF area coordinator for Southern California, stated
the organization is not political, that the membership works in
cooperation with United Nations and non- United Nations organizations
on behalf of need children; the organization depends entirely on
volunteers. All supplies and equipment are distributed under strict
rules of control, receiving governments must keep accurate records;
and the UNICEF program has been supported by every President and
religious organization since its inception.
Councilman Dennis seconded motion to approve. Councilman Dennis
stated he believes any charitable organization can be criticized
however, any local group which is convinced the cause they support is
warranted, deserves to have the opportunity to solicit support from
the community. It is not Council's prerogative to make judgment as
to whether a cause is good or bad, since the citizens will make that
decision when asked to contribute.
Councilman Gillanders stated he doesn't support the organization but
Council does not have grounds to deny the application.
Mayor Atkins stated he would not vote against the Church Women
United but would certainly urge residents to do their research and
decide whether they want to support UNICEF.
The motion to approve was carried without objection.

7. COMMUNICATIONS:
A. Board of Supervisors re: Los Angeles County Energy Commission
Fuel Reduction Recommendations
City Manager Koski presented a communication relating to a report
on fuel reduction recommendations approved by the Los Angeles
County Board of Supervisors at their meeting held July 15, 1980.
Councilman Tyrell moved to receive and file, seconded by Councilman
Merritt and carried.
8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
A. Boyce O'Bannon, 10316 Olive Street, stated he felt the Council
should take a look at Section 4604 of the Municipal Code, because
in his opinion unless Council agrees with the program they should
not approve a permit to solicit because he feels Council's granting
a permit is an implied approval of the program.
Mike Fowser, former resident of Temple City, addressed Council
relative to a recent incident at the Kerkochian Inn, and was advised
Council would not discuss the matter until the Sheriff's Department
has concluded its investigation and Council receives a report,
at which time Mr. Fowser would have an opportunity to present his
complaint.
RECESS TO CRA:
City Council recessed at 8:28 p.m. to meet as the Community Redevelopment
Agency, all members being present; approved the minutes of the regular
meeting held August 19, 1980; approved proposed commercial building at
8831 -8841 E. Las Tunas Drive; and adopted resolution approving warrants
and demands. The minutes of the Agency are set forth in the records of
the Agency.
RECONVENE AS CITY COUNCIL:
9. ACTION ON REQUEST BY CRA:
There was no action to be taken.
10. MATTERS FROM CITY OFFICIALS:
A. League of California Cities - October 19 -22, 1980 - Los Angeles
Councilman Tyrell moved to authorize advance registration for City
Officials attending subject conference as set forth in memo dated
August 29 and on file in the City Clerk's office, seconded by
Councilman Merritt and carried.
11. ADJOURNMENT:
Councilman Merritt moved to adjourn at 8:50 p.m., seconded by
Councilman Tyrell and carried. The next regular meeting of the City
Council will be held Tuesday, September 16, 1980, 7:30 p.m. in the
Council Chamber of the City Hall.
