A RESOLUTION.OF THE'CITY COUNCIL OF THE CITY
". OF LYNWOOD APPROVING A VARIANCE TO PERMIT
THE SALE OF: ALCOHOLIC BEVERAGES ON LOT 10, "
TRACT 5686, "SPECIFICALLY KNOWN AS 12006 SOUTH
ATLAN.TLC AVENUE,. LYNWOOD. '
WHEREAS, the Lynwood City Council, pursuant tb law, did
. hold. a .public, hearing . on the application' of Raul Ornel-as for a ,-
Variance to~sell alcoholic beverages on L'ot l0, Tract 5686,
~•12.OU6 South Atlantic Avenue,' Lynwood,~California; and
. WHEREAS; the subject business. has been closed for more
than six (6) months, reopening the. premises for alcoholic beverage
" salE~s requires compliance .with current codes; and
• WHEREAS, the subject"property is .less than 300 feet from
residentially zoned properties; and
WHEREAS,.the.Planning Commission considered all pertinent
testimony .offered in•the case a°s. presented in the public hearing
and has adopted its"Resolution.No'. 702; and
.WHEREAS, said City Council, after providing notice thereof,,
• as required by law, has held.-and conducted a public hearing, to
consider said application',-has heard; and, considered all pertinent ~ `
` -' evidence presented;
" NOW, THEREFORE,..BE IT RESOLVED,'. that the City Council of
the City of Lynwood hereby does ..find, determine, and order as follows:
Section 1. That there are exceptional or extraordinary
circumstances or conditions applicable to the property
. involved ar to the intended use of the property, that.
do not apply generally"to the property or class of.uses ,
in the same vicinity. or zone; and. ;
. Secton'2.~ "That such Variance is necessary .for the pre-
nervation-and enjoyment of .a substantial property right
of the ,applicant possessed by other.property in the .
same vicinity or zone;. and -
Section 3. That the granting of -such Variance will not,
' be materially detrimental to the public welfare,-or
injurious to the property or .improvements in such
. vicinity and-zone in which. property is-located; and, '
Section 4.-That the granting of such Variance will not
adversely affect the Comprehensive General, Plan;. "
BE IT°FURTHER RESOLVED, that said Commission grants a
Variance to Raul Ornelas to sell alcoholic beverages on Lot 10,

Avenue, Lynwood, California 90262,` subject to the following. ~~
conditions: •
1. That all conditions o£ the Fire Department,
Building Department, and the Engineering
Department be adhered to; and.

~2. 'That direct access to the apartments at the
~~ rear of the property from the restaurant be•
blocked off and exclusive., lockable, fenced
access.'to those apartments be via the drive-
way.. at the south of the building.; '.and
3. That all .access into. the. facility be off the .
. sidewalk on Atlantic Avenue., or the parking
lot to the north;. and. -
4: That appropriate. trash bins be provided at
the, rear of .the property facing the parking
lot to the north; and. .

5. TYiat a six .foot (6') concrete block wall be
installed: {a) on the-north boundary~~of~~the '
property between. the ,parking lot and-the
apartment building at the rear of the restaurant;.
and {b) at the rear of, the parking lot to
buffer the residential properties to the east; and,
.. 6. That the establishment'be operated as a family
-style restaurant,' With:~.neaher ~pool':tables nor
.dance floor to be permitted, and no dancing ,
shall. be permitted under 'any circumstances; and
7. If the conditions .hereby imposed. on the project
are not met within. six {6),months of the ~,
issuance of the .Variance, that Variance No. `
80012 be declared null and void, with noti-
fication.being issued to .the State Department
of Alcoholic Beverage Control; and
. ~ 8. No Certificate of Occupancy shall be'ssued
unless and until the Planning Director shall '
determne'that.the pool table has been removed,
the dance floor removed or carpeted over, and
the.othex conditions hereof have been met.
