HomeMy Public PortalAbout1990-05Member and moved its adoption: ei_f} introduced the following resolution CITY OF MEDINA _ Resolution No. cI G- RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO DENNIS HECKER FOR THE PROPERTY AT 1880 BUCKSKIN DRIVE. WHEREAS, Dennis Hecker (Applicant) has applied for a conditional use permit to construct an addition to the barn and to build two additional accessory buildings on his property located at 1880 Buckskin Drive; and WHEREAS, the barn addition and new accessory buildings, together with the existing accessory building, will total 6,555 square feet; and WHEREAS, the City's zoning ordinance requires a conditional use permit for accessory structures which total more than 3,000 square feet; and WHEREAS, this matter was reviewed by the Medina Planning Commission on January 9, 1990 and by the City Council on February 6, 1990; and WHEREAS, it has been determined that the existence of an additional 3,555 square feet in accessory structures on the Applicant's property will not impede the development of surrounding land. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of ! r Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant warrants that the accessory structures on his property are for his personal use and that no commercial use shall be made of them. The Applicant further promises that he will not board horses owned by others at his barn and that no horse shows will be held on the property. 2. The total area of the accessory structures after completion shall not exceed 6,750 square feet. 3. The Applicant shall comply with MPCA standards regarding removal of manure. 4. There shall be no exterior loudspeakers or outside telephone bell. 5. The maximum number of employees on the site shall not exceed six. 6. There shall be no living quarters in any of the accessory structures. 7. The maximum number of horses on the site shall not exceed 15. 8. The site plan for the property shall be reviewed by the Fire Department. 1 i 9. The Applicant shall ensure that the accessory structures comply with all City ordinances, including the requirement for a setback of 150 feet from all property lines for animal structures. 10. A11 exterior lighting shall be residential in character and shall be designed and installed so as not to cast light onto adjacent properties or roadways. 11. The Applicant shall maintain all fencing in good repair. 12. The Applicant shall keep all pool and tennis equipment inside. 13. The accessory building which the Applicant began to construct prior to the issuance of a building permit must be removed before any new construction may begin. 14. There shall be no restroom facilities in the cabana. 15. If the Applicant wishes to add a riding arena or paddock, site and grading plans must be reviewed by City staff prior to construction. 16. The Applicant shall manage runoff from the riding area or manure storage in a manner satisfactory to City staff. 17. The Applicant shall pay to the City a fee in an amount equal to the City's cost in reviewing and issuing the conditional use permit. 18. Any violation of the terms of this conditional use permit or of any City ordinance related thereto shall be grounds for revocation of this conditional use permit.
