Resolution No. 90_ 7
RESOLUTION GRANTING APPROVAL TO A
LOT COMBINATION/DIVISION TO RANDAL
SCHUMACHER.
WHEREAS, Randal Schumacher (Applicant) is the owner of property legally
described as Lots 15, 16 and 17, Block 19, Independence Beach, according to the
plat thereof on file in Hennepin County (Property); and
WHEREAS, the Applicant wishes to combine said three lots and to redivide
the resulting land into two lots, each containing 9,000 square feet; and
WHEREAS, this matter was reviewed by the Planning Commission on
January 9, 1990 and by the City Council on February 6, 1990.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that approval be granted to the Applicant for a lot
combination/division of the Property, subject to the following conditions:
1. The Applicant must check the depth of the sewer pipe in the street
prior to construction and recognize that the sewer main may be at a higher
elevation than the basement of the houses to be built.
2. The Applicant must obtain the approval of the Department of Natural
Resources and The Watershed District for the lot combination/division.
3. The City does not guarantee or make any representations regarding
the buildability of the resulting two lots.
4. The basement pad and footings shall be designed and built to the
satisfaction of the City engineer and building official.
5. The Applicant must provide proper surface drainage on the site.
6. The Applicant shall pay to the City for administrative expenses the
amount determined by the City staff to represent the actual cost to the City of
reviewing this lot combination/division.
7._. No park fees are duebecause these were previously platted lots.
8. The Applicant shall pay additional sewer and water fees at the
time a building permit is issued for either lot in the amount of: $904.80
for water and $1,354.20 for sewer.
