RESOLUTION NO. 80-139
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DENYING
A CONDITIONAL USE PERMIT TO ALLOW THE DAETWEILER TIRE COMPANY
TO SELL SECOND-HAND MATERIALS AT 3366-3370 EAST IMPERIAL HIGHWAY,
LEGALLY DESCRIBED AS LOT 166 AND THE EAST FOUR FEET OF LOT 167,
TRACT 2551.
WHEREAS, the Planning Commission of the City of Lynwood, after giving notice
thereof, as required by law, has held and conducted a Public Hearing to consider said
application and, based upon the evidence presented, has adopted its Resolution No. 706
denying said application;
WHEREAS, the Lynwood City Council, pursuant to law, did on October 7, 1980,
hold a Public Hearing on the application of W. T. Brady, President of Daetweiler Tire
and Auto Supply, Inc., to permit the sale of second-hand materials at 3366-3370 East
Imperial-Highway;
WHEREAS, the use for which the Conditional Use Permit is requested is not a
permitted use of the existing zoning on the property (C-2);
WHEREAS, the proposed use does not fall within the definition of a second-hand
store;
WHEREAS, Conditional Use Permit is contingent on a change of zone from C-2 to
C-3;
WHEREAS, the required zone change has been denied by the City Council;
WHEREAS, the Council has Earefully considered all pertinent testimony offered
in the case, as presented at the Public Hearing;
NOW, THEREFORE, BE IT RESOLVED, that the City Council finds and concludes
that:
Section 1. The proposed Conditional Use Permit would adversely affect the
adjoining property values and would be detrimental to the .adjacent residential
area ;
Section 2. The Conditional Use Permit would not be in the interest of public
health, safety and general welfare;
Section 3. Approval of said Conditional Use Permit woulid adversely affect,
or not be in compliance with, the City of Lynwood General Plan.
NOW, THEREFORE, BE IT RESOLVED, that the City Council finds and concludes
that:
1. The approval of a Conditional Use Permit for the proposed use is con-
tingent upon the approval of a change in the zoning of the subject parcel from C-2 to
C-3;
2. The subject zone change has been denied by this Council.
BE IT FURTHER RESOLVED, that this Council denies the Conditional Use Permit '
