COUNCIL MINUTES
March 31, 1981
The Council of Bal Harbour Village met Tuesday, March 31,
1981 at 9:30 A.M. in the Village Hall.
Present: Miss Gray and Messrs. Beatty, Krez, Printup 8 Taplin
Also present were Fred W. Maley, Village Manager; Mary T.
Wetterer, Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Taplin, seconded by Mr. Krez and voted
the minutes of February 24, 1981 were approved as amended to reflect
the council temporarily approved helicopter sightseeing services
at Bakers Haulover only if they would continue their policy of not
flying over Bal Harbour as promised by Messrs. Paul Wood of the
helicopter service and James Green of the Helicopter Pilots Associa-
tion.
A Public Hearing was held to consider applications for a Cable
Television Franchise. Mr. Maley said he had asked Mr. Thomas Welstead
to review the three proposals on file and Mr. Welstead would make
his comments later. The council considered proposals from Mr.
Charles C. Hermanowski of Cable/Satellite Associates, a subsidiary
of Ameri-Cable; Mr. Jesse H. Riebman of UltraCom of Dade County, Inc.;
and Mr. Frank Cipparone of Video Design Systems, Inc. Discussed
with all the applicants were proposed rate structures, time of in-
stallation and services available. Mr. Welstead stated that he has
no interest in any cable television company, and that his review
found that all three companies have the ability to build or have
built the facilities needed. He said that inasmuch as all companies
were relatively equal that the decision should be made on who has
the facilities to maintain the system on a daily basis. He said it
is his belief that due to the proximity of their offices and pro-
viding services to the surrounding communities that U1traCom
would be better suited to serve Bal Harbour. It was moved by Mr.
Beatty, seconded by Mr. Taplin and voted that a decision would be
made at the council meeting to be held April 14, 1981.

Mr. Maley said that he was not prepared to make a recommenda-
tion on hiring one of the three trust companies who have sub-
mitted proposals to manage the Bal Harbour Village Employees
Pension Trust. He said that he would like more input from the
council regarding the length of time for a contract and also what
type of discretionary powers, if any, the consultant would have.
It was moved by Mr. Beatty, seconded by Miss Gray and voted
that the council contact the Village Manger to give their input
and that the matter would be discussed again at the April 14th
meeting
Mr. Gold reported that he had read Ordinance No 228 in full
at the January 27, 1981 meeting while discussing the provisions
of that ordinance. Mr. Gold then read
ORDINANCE No. 228
governing storm shutters and balcony enclosures in the Ocean
Front District. On motion of Mr. Beatty, seconded by Mr. Krez
and voted the ordinance was adopted by title.
On motion of Mr. Taplin, seconded by Miss Gray and voted the
Sheraton-Bal Harbour Hotel was granted use of the garage space
for convention purposes May 26-29, 1981.
Mr. Krez and Mr. Maley explained that when the village sewer
pump station breaks down it sometimes causes a sewage backup
on two properties that are low on Collins Avenue. Mr. Krez said
his apartment building had about $500.00 in bills to a plumbing
contractor to clean service lines after this happens. Mr. Maley
said it was the policy of the village to pay for any work done
under public property, but not on pri.vate property and he asked
what the liability of the village should be in such cases. Mr.
Gold said he would research this matter.
Mr. Maley advised that Coral Gables has asked Dade County
League of Cities to petition Dade County to make older buildings
conform to the new Dade County Fire Code. He said that the League
may consider it if other cities were interested. Mr. Taplin
said that he had been investigating installing smoke detectors
in his building and would give the village the results of his
investigations in about 60 days.
Mr. Maley said that last fallthe employees were given an
8 % raise, which proved to be low due to the economy. He pointed
out that other cities had used 10% to 12% and some as high as 20%
over 2 years. He said he would like to give a 4% raise across-
the-board to all employees which would cost about $19,000 for
the next six months. It was moved by Mr. Taplin, seconded by Miss
Gray and voted that the raise be granted.
The Mayor reported he has received a resolution from the
City of Sweetwater stating that they have sent $500 to Atlanta
to help in their investigation of the mass murders of black children,
and that they were asking other cities to do likewise. It was
suggested that Mr. Maley write Atlanta to see what the situation
is regarding donations.

The possibility of giving retired council members who
have served more than twenty years an annual pension of $20.00
for each year served was discussed. The council decided against
this suggestion.
Mr. Krez said that the last four years have been an ex-
citing time for him while serving on the council. He learned
that no matter which way you vote you will loose some friends.
He is comforted by the fact that he has learned a great deal
about local government, and it has been a pleasure for him to
serve.
On motion of Mr. Krez, seconded by Mr. Taplin, the meeting
was adjourned at 12:05 P.M.

The Council of Bal Harbour Village met Tuesday, April
14, 1981 at 9:30 A.M. in the Village Hall.
Present: Messrs. Krez, Printup and Tapline and Miss Gray
Absent: Mr. Beatty
Also present were Fred W. Maley, Village Manager; Mary T.
Wetterer, Village Clerk; and Alan S. Gold, Village Attorney
Mr. Maley informed the council that he had checked with
Dade County officials regarding the manner they have been award-
ing cable television franchises to various companies and assign-
ing service areas in different parts of the County. He was ad-
vised that these areas are not exclusive. After study, Mr. Maley
said he would recommend awarding the Bal Harbour franchise to
UltaCom of Dade County, Inc. for the following reasons: The
proximity of their main offices in North Bay Village which will
allow our citizens easier access to their offices and broadcast
studio; better coordination with local utilities; familiarity
with the area which would permit dispatchers to route emergency
calls to the proper agencies; being served by the same company
as our neighboring communities will allow us to band together
to ensure better programing and service. Mr. Charles Hermanowski
