HomeMy Public PortalAbout1990-20Member adoption: e i5 introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. `�` (;7) RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JACK MACHULA WHEREAS, Jack Machula (Applicant) has applied for a conditional use permit to build a 4,367 square foot industrial building at 3568 Pinto Drive, which property is legally described as Lot 4, Block 2, Medina Industrial Addition; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the Applicant has previously been granted a conditional use permit to develop the adjacent property to the south (Lot 5, Block 2, Medina Industrial Addition) pursuant to Resolution No. 84-37; and WHEREAS, this matter has been reviewed by the planning commission on March 13, 1990, and by the City Council on April 3, 1990; and WHEREAS, it has been determined that the existence of an industrial building at the above address will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purposed, subject to the following terms and conditions: 1. The Applicant shall combine the subject property (Lot 4, Block 2) with the property to the south (Lot 5, Block 2); 2. There shall be no outside storage on the site; 3. The exterior building materials shall be as shown to the City and shall be in compliance with all City requirements; 4. Any signs on the site shall comply with City requirements; 1 5. The trash dumpster shall be placed inside, if possible. If the trash dumpster is placed outside, it shall be surrounded by an opaque fence satisfactory to the City staff; 6. Any rooftop mechanical equipment shall be screened so as not to be visible from adjacent properties or roadways; 7. The Applicant shall install landscaping in compliance with ordinance requirements and which is satisfactory to City staff; 8. The parking on the site shall be as approved by City staff and shall include one signed handicapped space; 9. The parking lot and driveway shall be blacktopped and curbed; 10. The hours of operation shall be 6:00 a.m. to 11:00 p.m., seven days per week. 11. The number of employees shall not exceed 15 per shift; 12. Outside lighting shall be designed and installed so as not to cast light directly on adjacent properties or roadways; 13. The Applicant shall grant to the City the drainage and utility easements required by the City engineer; 14. There shall be no outside loudspeakers or telephone bell; 15. The site plan and building shallbe reviewed by the Fire Department; 16. Driveway access to Pinto Drive shall be as approved by the City engineer and staff; 17. The Applicant shall grant to the City the right-of-way for Pinto Drive required by the City engineer; 18. The Applicant shall prepare an as -built survey of the site showing the building, parking, driveway and drainage easements; 19. The Applicant shall post with the City a letter of credit in the amount of $14,205 to ensure completion of the site work; 20. Any violation of the terms of this conditional use permit or of any City ordinance relating thereto shall be grounds from revocation of the permit; and 21. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the Applicant shall be granted the following variances: 2 1. Reduce sideyard setback to the south from 30 feet to 0 feet; and 2. Reduce rearyard setback (to the east) from 30 feet to 15 feet at the closest point of the structure on the grounds that such variances are consistent with neighborhood standards, and in recognition of the fact that the lot is small and was created prior to the enactment of the City's zoning ordinance.
