RESOLUTION VACATING A PORTION OF EVERGREEN ROAD WHEREAS, Hans Hagen Homes, Inc. requested that the City of Medina (City) vacate a portion of Evergreen Road; and WHEREAS, Minnesota Statutes Section 412.851 permits the City to vacate the requested portion of the road after a public hearing following two weeks' published and posted notice; and WHEREAS, a public hearing was held before the city council on March 20, 1990, following the notice required by statute; and WHEREAS, at the public hearing the city council heard the testimony from all interested parties wishing to speak on the matter and consulted the city engineer regarding the desirability of retaining the subject portion of Evergreen Road for use by the public. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. The vacation of that portion of Evergreen Road described as commencing at the North West corner of Lot 3, Block 1, TRA Addition; thence North 0 degrees 13' 19" West 60 feet; thence North 88 degrees 57' 47"E 120 feet, thence South 0 degrees 13' 19" East 60 feet; thence South 88 degrees 57' 47" West 120 feet to the point of beginning and there terminating. All located in Section 12, Township 118, Range 23 West Hennepin County Minnesota is found to be in the public interest and said portion is hereby vacated. 2. The clerk -treasurer is authorized and directed to prepare a notice of the completion of these proceedings for presentation to the Hennepin county auditor. The notice shall contain the name of the city, an identification of the vacation, a statement of the time of completion thereof and a description of the real estate and lands affected thereby. 3. The clerk -treasurer is also authorized and directed to take any other acts reasonably necessary to carry out the intent of the city council in this matter. DATED: 1 17 , 1990.
