CALL TO ORDER: Mayor Atkinscalled_the Special.Meeting of the City Council to order at 7 :36 p.m. on Tuesday, September 30, 1980, in the Council Chamber of the City Hall. 2. The Pledge of Allegiance to the Flag was led by Mayor Atkins. 3. ROLL CALL: Present: Councilmen- Dennis, Gillanders, Merritt, Atkins Absent: Councilman Tyrell Also Present: Assistant City Manager Kimbrough, Planning Director Dragicevich At this time, Mayor Atkins requested that Councilman Tyrell be excused from the-meeting due to"= a'. prior, . long-standing commitment. Council- man Dennis moved.to approve his absence, seconded by Councilman Gillanders. The Mayor informed the Council that Councilman Tyrell had reviewed the material and concurred with the recommendation. 4. STAFF REPORT REGARDING PROPOSED ISLAND ANNEXATIONS 80 -1 AND 80 -2 Assistant City Manager Kimbrough. reviewed the staff report (highlights following) on the annexations. The annexations had been recommended by the Los Angeles. County. Local. Formation Commission (LAFCO) under the Municipal Organization Act of 1977. This act eliminated the requirement for elections by the voters within the islands and gave the Board of Supervisors the responsibility to conduct the annexations. The two annexations that were considered are: Annexation,80- 1'bounded on the west by the City of San Gabriel (Burton Avenue), Longden Avenue on the north, Eaton Wash (the pre- sent City limits of :Temple-City) "on -the east,. and Hermosa Drive on the south. It has.an area of approximately 42.6 acres of land with 143 dwelling.units and-an estimated population of 385. The entire area is zoned R -1. Annexation 80 =2 bounded by Temple City Boulevard on the west, the City of Arcadia city bbundar-y :on the north and east, and Lemon Avenue on the south. It is zoned R -1 and R-3; and has a land area of 84 acres with 551 :dwelling units and an estimated population of 1,310. The area at the northwest.corner of Naomi and Golden West is zoned R -3 (twenty -nine units per acre). In the Sheriff's Department report, they reviewed the potential annexation which they currently serve, but not with Temple City units. They advised that area 80 -1 was small, relatively crime -free and could readily be". absorbed :by the City units. In area 80 -2, which is larger and is adjacent to the. Temple City High School, the department foresees an increase in calls for service by the City units. The department already receives many calls on speeding Special Council Meeting, September 30, 1980 - Page 2 vehicles and disturbing juveniles and sees a distinct advantage to these problems being handled by them. Assistant City Manager Kimbrough informed the Council that the overall response time for all calls for service .. within the City of Temple City is 6.5 minutes as opposed to the response time outside the City limits which is 8.1 minutes. In the Fire Department:report,.:theyreviewed the potential annex- ations and could foresee no impact on the department. because both the City and the.potentiai.annexation areas are being serviced by the Los Angeles County Fire Department. In the County Road Department report, the streets in the potential annexation areas were at a level comparable to the..City of Temple City and are not in..need of major repair. Area 80 -1 is due for Slurry Seal and the Road Department will l -be providing cost estimates for the work. Area 80 -1 has .no. curb and gutter. George Dragecivich mentioned that this.,.area._is very similar to the part of the City from Hermosa to Muscatel over to Rosemead Blvd. In the City Parks and.Recreation.Department review, the proposed annexations have no major. impact. Currently, the residents of both annexation areas -are receiving many .of the City's recreation services. Assistant City Manager Kimbrough reported that County residents. must presently apply for any Parks and Recreation classes the day after :City:residents apply. .This, of course, will change with the annexation of both-80 =1 and 80 -2. The Community, Disposal.: Company:,: which provides refuse service and street.sweeping.services.to the City of Temple City, reviewed both annexation areas .in.,.their.report. They currently provide refuse service to these.areas_.with the.exception of. some multiple dwelling.units, and. -if an.nexed,..would continue to do so. The approximate_costs:for; sweeper services.are.$524 per year for 80 -1 and $1, 670.. per_ year..for..80 -2_.. The..Mayor inquired as . to the cost for the.residents.in.: the ..potential_annexation.areas.. .Assistant City Manager _Kimbrough;explained -that.the potential. annexation areas..are :presentlyserved.only.:once a week..as:opposed to the twice weekly pick - -up: in, the.. City_.of .Temple. City.: If annexed, , they would be served twice weekly and would have to incur the increase in the cost. Assistant .City_Mariager_Kimbrough_ responded to questions by the Council regarding the following: Councilman ..Gil.landers. was concerned_as to whom Burton Avenue would belong to after..the_annexation. The..legal.description for the annexation 80- 2... (in ...this .situation).was. worked up by the County Engineer,_ and_Temple_City _ would.be responsible for all of Burton Avenue.._. Comments .were..expressed.concerning the fact that Temple City has_never. been able to annex an area without gaining an entire street. Councilman Gillanders.. commented .on_.the fact that there is still some County area ._left_for_possible_annexation on. the .Arcadia line in area _ 80- 2 ._._The_.Mayor:advised_.Council that the limit to an annexation area is 100 acres. Revenue generated _in_.80- 1 :isiestimated at. $3,971 for_gas tax and $6, 868 for_in_lieu_taxe._...Revenue generated _in.80- 2..is.estimated at $13., 370._ for: gas ..tax :_andl$23,370.for.in.:lieu tax. The combined estimated total for revenue for 80 -1 and 80 -2 is $47,579. Special Council Meeting, September 30, 1980 - Page 3 Council was reminded that only safety improvements are mandatory. and that the annexed areas would not differ from other City areas. If capital improvements.are.needed, property owners would have to be petitioned.. If passed, the'property owners would have to pay for the work. A change in the postal zone would not take place unless requested by the residents in the potential annexation areas. Residents in area 80 -1 presently have the San Gabriel postal zone, and residents in area 80 -2 presently have the Arcadia postal zone. George Dragicevich expressed his review of the areas from his physical inspection of them. Area No. .80 -1 is a much cleaner area than area No, 80 -2 and is legal in non- conforming use. Area No. 80 -2 consists 'vf approximately 25% of deep lots, two on a lot, and sections that are landlocked. Councilman Dennis expressed his desire for a package to be sent to all the residents in the proposed annexed areas explaining the City of Temple City regulations. Assistant City Manager Kimbrough.confirmed that Patti Bates is presently working on a letter to the residents which will be forwarded to the residents in the annexation areas after the notification by LAFCO. Assistant City Manager Kimbrough reviewed the following procedures for the annexations: 1. On October 1, 1980, the following are to be presented to LAFCO. Resolution of Application. for No. 80 -1 Resolution of Application for No. 80 -2 Joint Resolution for Property Tax Revenue for No. 80 -1 Joint Resolution for Property Tax Revenue for No. 80 -2 2. On October 7, 1980, the Board of Supervisors will adopt the joint resolutions for both annexations regarding property taxes. 3. On October 29, 1980, there will be a hearing by LAFCO on the resolutions. After approval by LAFCO, legal notices will be sent to residents. 4. If the above resolutions are approved, the Board of Supervisors will adopt, on November 12, 1980, the resolutions to initiate proceedings and set a public hearing for December 18, 1980, 5. If adopted, LAFCO will adopt the approved resolutions prior to January 1, 1980, Mayor Atkins advised that the applications for annexation, include,a' negative declaration of environmental impact pursuant to the California Environmental Quality Act of 1970. Said negative declara- tion states that the proposed .annexations will not have an adverse impact on the environment, Councilman Gillanders moved that the City Council certify that the Environmental Impact Report has been completed in conformance with the California Environmental Quality Act and the State guidelines and that the City Council has reviewed, considered and evaluated the information contained in the report; and, that the draft EIR is accepted as the "Final EIR ", and is adequate and provides reasonable information..on the project and all reasonable and feasible alternatives thereto, including "no project "; that the project is consistent and compatible with existing zoning and the general plan; and, that each and every adverse environmental impact contained in the report=,::is overruled or counterbalanced: that miti- gation of such adverse effects is not feasible under the circum- stances and by economic and social needs, objectives, and concerns in providing private or public improvements of municipal import, seconded by Councilman Merritt and carried. Special Council Meeting, September 30, 1980 - Page 4 Councilman Gillanders expressed his concern regarding the'JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF TEMPLE ,CITY APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM ANNEXATION OF UNINCORPORATED TERRITORY .TOT.HE•CITY OF TEMPLE CITY, ANNEXATION NO?. 80 -1 AND ANNEXATION NO. 80 -2. Presently, Temple City does not receive 25% of the 1% property tax assessed property owners in the City. Councilman Gillanders would like to see a distribution which would return the money to the City for schools, recreation, etc. The Mayor, the City Attorney, and the Assistant City Manager advised that the joint resolutions are really irrelevant, but necessary in the annexation procedures. The City Attorney and the Mayor suggested that this be worked out at a later date. 5. RESOLUTION NO. 80 -1932 RELATING TO APPLICATION FOR ANNEXATION OF ANNEXATION NO. 80 -1. Councilman Gillanders moved to adopt Resolution No. 80 -1932 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING SUBMISSION OF THE LOCAL AGENCY. FORMATION COMMISSION OF THE COUNTY OF LOS ANGELES, OF AN APPLICATION FOR ANNEXATION TO COMMENCE PRO- CEEDINGS FOR ANNEXATION TO NO. 80 -1, PURSUANT TO THE PROCEDURES ESTABLISHED BY "MUNICIPAL ORGANIZATION ACT, 1977" (ISLAND ANNEXA- TION - 100 ACRES OR LESS), seconded by Councilman Merritt and carried. RESOLUTION NO. 80 -1933 RELATING TO APPLICATION FOR ANNEXATION OF ANNEXATION NO. 80 -2. Councilman Gillanders moved to adopt Resolution No. 80 -1933 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING SUBMISSION OF THE LOCAL. EXCHANGE OF PROPERTY TAX. REVENUES RE- SULTING FROM ANNEXATION OF UNINCORPORATED TERRITORY TO THE CITY OF TEMPLE CITY " "ANNEXATION "NO. 80-1 ", seconded by Councilman Merritt and carried.
