ORDINANCE NO. 14723
AN ORDINANCE SUBMITTING THE PROPOSED ORDINANCE ELIMINATING THE
REQUIREMENT THAT TRASH ONLY BE COLLECTED BY AN AUTHORIZED
COLLECTOR, AS SUBMITTED BY AN INITIATIVE PETITION FROM REGISTERED
VOTERS OF THE CITY OF JEFFERSON, MISSOURI, AND SETTING THE DATE FOR
SUCH ELECTION.
WHEREAS, the City has received a valid petition pursuant to Article IX of the City
Charter; and,
WHEREAS, the City Clerk has certified that the required number of valid signatures of
registered voters of the City appear on the petition and that the petition
otherwise complies with the provisions of the Charter; and
WHEREAS, the City Council has declined to enact the code provision proposed by the
petitioners in substantially the same form; and,
WHEREAS, the Charter requires the Council in such a case to place the issue before the
voters within one year.
NOW, THEREFORE, BE IT ENACTED by the Council of the City of Jefferson, Missouri,
as follows:
Section 1. The ordinance proposed by the petitioners shall be submitted to the
qualified voters of the City of Jefferson, Missouri, for their approval, at the election to be
held on April 5, 2011, at the places designated by the County Clerk for said election and
the ballot shall be in substantially the following form:
Proposition 1
Shall the City Code (Chapter 30, Sections 1 and 2) of the City of Jefferson
be amended by retaining the requirement that every residence have trash
service but eliminating the requirement that trash only be collected by an
authorized collector?
[ ] Yes
[ ] No
If you are in favor of the question, place an "X" in the box opposite "Yes". If
you are opposed to the question, place an "X" in the box opposite "No".
Section 2. The Mayor and City Clerk shall prepare and execute the form of the
notice of said election and shall transmit the same to the election authority for the City of
Jefferson, Missouri, and request said election to be conducted by law.
Section 3. This ordinance shall be in full force and effect from and after its passage
and approval subject to the provisions herein contained which provide for voter approval
or for specific dates of effectiveness.
