HomeMy Public PortalAbout1990-32Member adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 4715-3,=2 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO PAUL PIEKARSKI WHEREAS, Paul Piekarski (Applicant) has applied for a conditional use permit to operate a landscaping business from the property at 3575 Pinto Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the matter has been reviewed by the planning commission on April 10, 1990, and by the City Council on May 1, 1990; and WHEREAS, it has been determined that the existence of the proposed landscaping business at the above address will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant shall construct the driveway between the garage and metal accessory building and shall locate three parking spaces behind the accessory building and one behind the garage. A fifth space shall be built in a location agreed upon by the Applicant and city staff; 2. There shall be no exterior storage on site; 3. The exterior of the metal accessory building shall be brought into compliance with City performance standards within three years of the date of this resolution; 4. Any signs on site shall be in compliance with City ordinances; 5. The driveway shall be black topped to the west end of the garage no later than June 1, 1991; 6. The exterior trash container shall be screened with an opaque material so that it is not visible from adjacent properties or roadways; 7. The two trees on the north side of the garage shall remain as they are; 8. The general hours of business operation shall be restricted to 6:00 a.m. to 9:00 p.m., seven days per week; 9. The maximum number of employees is four; 10. Any exterior lighting on the site shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 11. The Applicant shall obtain from the adjacent property owner an easement for drainage which is satisfactory to the city engineer; 12. There shall be no outside telephone bell or loudspeaker; 13. The fire department shall review the site; 14. The Applicant shall convey to the City the right-of-way for Co. Rd. 116 required by the city engineer; 15. The Applicant shall clear the site of all debris to the satisfaction of the city staff; 16. Any on -site repair work which involves noise may be performed only during the hours of 9:00 a.m. to 5:00 p.m. Monday through Friday. The work must be performed inside and only on the Applicant's business equipment; 17. The black topping of the parking area on the north and west side of the metal accessory building shall be completed within three years of the date of this resolution; 18. The Applicant shall post a bond with the City in the amount of $ to ensure completion of all site work in a timely manner; 19. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application; and 20. Any violation of the terms of this conditional use permit or of any City ordinance related thereto shall be grounds for revocation of this permit. DATED: /1'1, l � , 1990.
