HomeMy Public PortalAbout1990-34Member adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. , RESOLUTION DENYING A CONDITIONAL USE PERMIT TO ROBIN RUBEN FOR AN EQUESTRIAN CENTER FOR BOARDING AND TRAINING, RIDING AND RIDING INSTRUCTION AT 4555 PIONEER TRAIL WHEREAS, Robin Ruben (Applicant), with the consent of Tom Kellin (Owner), has applied for a conditional use permit to operate an equestrian center on the property located at 4555 Pioneer Trail (Property); and WHEREAS, the Applicant proposes to board and train up to forty horses, allow the owners of such forty horses to ride at the facility and to offer riding instruction to the horse owners and others at the Property; and WHEREAS, the Property is zoned rural residential; and WHEREAS, use of the Property to board and train horses, allow up to forty owners to ride their horses and offer riding instruction constitutes a commercial riding stable, not a stable for the owners' personal use and not a personal horse farm, and is not permitted by the City's zoning ordinance in the rural residential zone; and WHEREAS, "farms," including horse farms, are a permitted use in the rural residential zone; and WHEREAS, "kennels and riding stables" are permitted by conditional use permit under the City's zoning ordinance in the rural residential zone but only for the private, noncommercial use of the property owner; and WHEREAS, the City does not grant conditional use permits for commercial kennels or riding stables in the rural residential zone; and WHEREAS, the Property is currently under a 1986 conditional use permit requested by the Owner which explicitly confines the use of the horse facility to the property owner and requires that all horses kept on site be owned by the property owner; and WHEREAS, the Applicant did not demonstrate the adequacy of the site with regard to the matters of concern to the Medina planning commission as outlined in the minutes of the April 10, 1990, planning commission meeting attached hereto. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the Applicant's request for a conditional use permit is hereby denied, for the following reasons: 1. The Applicant's proposal to use the Property to board and train up to forty horses, to provide a riding area for the owners of such horses and to offer riding instruction to such horse owners and other customers constitutes the operation of a commercial riding stable; 2. A commercial riding stable is not permitted as of right or by conditional use permit in the rural residential zone; and 3. There exist substantial and unresolved questions regarding the adequacy of the existing on -site septic system, the availability of a viable alternative septic site as required by city code, parking and numerous other site problems if it were to be put to a commercial use.
