AN ORDINANCE, making an appropriation of Three Hundred Thirty Thousand
Dollars ($330,000.00) from the Operations, Maintenance, Construction, Improvement Fund of
Deer Creek to be used for channel stabilization in Ballas Rd. - Balwyck Ln. Bank Stabilization
(11176) in the City of Des Peres, Missouri; and authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 22242
with Gershenson Construction Co., Inc. for channel stabilization.
WHEREAS, the bid for said channel stabilization is Two Hundred Ninety-One
Thousand Fifty-One Dollars and Forty Cents ($291,051.40) and the allowance for construction
change orders and other project expenses is Thirty Eight Thousand Nine Hundred Forty-Six
Thousand Dollars and Sixty Cents ($38,948.60); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Thirty Thousand Dollars ($330,000.00)
is hereby appropriated from the Operations, Maintenance, Construction, Improvement Fund of
Deer Creek for channel stabilization in Ballas Rd. - Balwyck Ln. Bank Stabilization (11176) in
the City of Des Peres, Missouri; said contract being comprised of such terms and conditions as
have been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 22242
with Gershenson Construction Co., Inc., as the lowest responsible bidder for channel stabilization
in Ballas Rd. - Balwyck Ln. Bank Stabilization (11176) in the City of Des Peres, Missouri,
pursuant to bids received on the 24th day of January, 2023.
The foregoing Ordinance was adopted on April 13, 2023 by the following vote:
Ayes - A. Fehr, R. Wilson, G. Nicozisin, M. Evans, B. Watson and B. Wahby
