HomeMy Public PortalAboutRES-CC-2017-33Resolution # 33 -2017 A RESOLUTION APPROVING AN INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF MOAB AND GRAND COUNTY, PERTAINING TO APPROVING THE RFP ANNOUNCEMENT TO PURSUE THE JOINT FUNDING OF AN ECONOMIC NEXUS STUDY TO SUPPORT AN ASSURED HOUSING ORDINANCE. WHEREAS, the governing body of the City of Moab desires to enter into an Interlocal Agreement with Grand County for the purpose of approving the RFP announcement and committing to equally sharing in the costs incurred for an economic study; AND WHEREAS, the economic study is an essential precursor to determining the feasibility and legality of an assured housing ordinance; AND WHEREAS, the City and County each commit to contributing an amount up to but not in excess of $40,000 for payment to the selected contractor; AND WHEREAS, the Agreement has been presented to this meeting of the City Council; NOW THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB DO HEREBY ADOPT THE AGREEMENT IN SUBSTANTIALLY THE FORM PRESENTED TO THIS MEETING OF THE CITY COUNCIL, AND AUTHORIZE THE APPROPRIATE INDIVIDUALS TO EXECUTE AND DELIVER SAID AGREEMENT. Sakrison Mayor Page 1 of 1 INTERLOCAL AGREEMENT FOR THE JOINT FUNDING OF AN ECONOMIC STUDY TO EVALUATE THE FEASIBILITY AND DESIGN OF AN ASSURED HOUSING ORDINANCE BY AND BETWEEN MOAB CITY, UTAH AND GRAND COUNTY, UTAH Whereas, the City of Moab ("City") and Grand County ("County") have both adopted affordable housing plans; and, Whereas, the City's and County's plans refer to the adoption of an assured housing ordinance as an action priority; and, Whereas, the City and County planning commissions have reviewed a draft assured housing ordinance; and, Whereas, an economic study is an essential precursor to determining the feasibility and legality of an assured housing ordinance; and, Whereas, an economic study will help to inform the appropriate affordable housing requirements and development incentives to be included in an assured housing ordinance; and, Whereas, a Request for Proposals ("RFP") has been drafted detailing the scope of work, submittal requirements, and selection process for contractors wishing to provide the City and County an economic study; and, Whereas, pursuant to the Interlocal Cooperation Act (Section 11-13-1 ed seq., Utah Code Annotated), and for the mutual benefit of the citizens and inhabitants of the City and County, governmental agencies may enter into interlocal agreements. Now therefore, the City and County hereby agree as follows: 1. Purpose of Agreement. The purpose of this agreement is to approve of the RFP announcement pursuant to [Utah public noticing requirements/GC and MC public noticing requirements] and commit to equally sharing in the costs incurred for an economic study. 2. Request for Proposals ("RFP"). The RFP is shown as Appendix A. 3. Financial Responsibilities. The City and County each commit to contributing an amount up to but not in excess of $40,000 for payment to the selected contractor. 4. Participation in RFP Selection Committee._ The City and the County shall each be represented by one elected Council member and two staff members on the RFP Selection Committee. A representative from the Interlocal Housing Task Force (Benjamin Riley, Housing Authority of Southeastern Utah) will also be included on the Selection Committee. 5. ,Effectiveness and Duration of Agreement. This agreement shall become effective immediately upon its approval by resolutions of the City Council and County Council. This agreement shall remain in effect until the economic study detailed in the RFP is completed, presented to each Council, and payment is remitted to the selected contractor following the fulfillment of its duties.
