HomeMy Public PortalAbout1990-38Member adoption: /_5 introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 90-3,ef RESOLUTION VACATING A PORTION OF HUNTER ROAD AND DRAINAGE AND UTILITY EASEMENTS WHEREAS, Hans Hagen Homes, Inc. requested that the City of Medina (City) vacate a portion of Hunter Road andd drainage and utility easements, and WHEREAS, Minnesota Statutes Section 412.851 permits the City to vacate the requested portion of the road after a public hearing following two weeks' published and posted notice; and WHEREAS, a public hearing was held before the city council on June 5, 1990, following the notice required by statute; and WHEREAS, at the public hearing the city council heard the testimony from all interested parties wishing to speak on the matter and consulted the city engineer regarding the desirability of retaining the subject portion of Hunter Road and drainage and utility easements for use by tn.e public. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. The vacation of that portion of Hunter Road and drainage and utility easements described on Exhibit A attached hereto is found to be in the -public interest and said portions are hereby vacated. 2. The clerk -treasurer is authorized and directed to prepare a notice of the completion of these proceedings for presentation to the Hennepin county auditor. The notice shall contain the name of the city, an identification of the vacation, a statement of the time of completion thereof and a description of the real estate and lands affected thereby. 3. The clerk -treasurer is also authorized and directed to take any other acts reasonably necessary to carry out the intent of the city council in this matter. IN DATED: .Ju , 1990. ADDITION, Section 12, Township 118, Range 23W, Hennepin County, Minnesota, lying southerly of the 60 foot radius circle whose center is defined on said plat. DESCRIPTION FOR EASEMENT VACATION The drainage and utility easements as dedicated on Lots 2 and 3, Block 1, T.R.A. ADDITION, Section 12, Township 118, Range 23W, Hennepin County, Minnesota.
