RESOLUTION NO. W- �4
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
TILE CARE PRODUCTS, INC.
WHEREAS, Tile Care Products, Inc. (Applicant) has applied for a conditional
use permit to construct an office/warehouse/manufacturing building containing
10,500 sq. ft. on Lots 4 and 5, Block 2, Medina Industrial 2nd Addition; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on
May 8, 1990, and by the City Council on June 5, 1990; and
WHEREAS, it has been determined that the existence of the proposed
office/warehouse/manufacturing facility will not impede the orderly development
of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that a conditional use permit be granted to the Applicant for
the stated purpose, subject to the following terms and conditions:
1. The Applicant shall construct an earth berm four feet in height in
front of the site along Tower Drive;
2. There shall be no outside storage on the site;
3. Any rooftop mechanical equipment shall be screened with an opaque
material so as not to be visible from adjacent properties or roadways;
4. If the trash dumpster is kept on the exterior of the building, it shall
be screened with an opaque material so as not to be visible from
adjacent properties or roadways;
5. Exterior lighting shall be designed and installed so that the globe is
recessed and enclosed on all sides except the bottom and that no light
is cast directly on any other property;
6. The plan for the building and site shall be reviewed by the fire
department;
7. The hours of operation shall be 5:00 a.m. to 8:00 p.m. Monday through
Saturday;
8. Any signs constructed on the property shall be in compliance with
city ordinance requirements;
9. The Applicant shall submit a letter of credit in the amount of
$26,775.00 to ensure completion of all site improvements;
10. The Applicant shall extend the storm sewer from the existing line to
the parking lot;
11. Landscaping shall be installed in compliance with city ordinance
requirements;
12. The elevation of the south driveway shall be raised to 1000.5 feet to
prevent street runoff from entering the parking area;
13. The depth of the parking spaces shall be in accordance with city
ordinance requirements;
14. The number of employees shall not exceed eight;
15. There shall be no outside loudspeaker or telephone bell;
16. The Applicant shall submit OSHA safety sheets to the City;
17. The Applicant shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing this
conditional use permit application; and
18. Any violation of the terms and conditions of this conditional use
permit or of the land use ordinances of the City shall be grounds for
revocation of this permit.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of
the City of Medina, Minnesota that the following variances be granted to the
Applicant on the grounds that the shape of the lot is a hardship and that these
variances would be consistent with neighborhood standards:
1. Reduce rear yard setback from 30 feet to 15 feet;
2. Reduce side yard setback on the north from 30 feet to 20 feet; and
3. Reduce side yard setback on the south from 30 feet to 27.5 feet.
