CITY COUNCIL
MINUTES
NOVEMBER 4, 1980
INITIATION:
1. CALL TO ORDER.:
Mayor Atkins called the regular meeting of the City Council to
order at 7.32 pom. on Tuesday, November 4, 1980, in the Council
Chamber of the City Hall,
2. INVOCATION:
The invocation was given by Rabbi Alan Lachtman, Temple Beth David,
9677 Longden Avenue,
3e The Pledge of Allegiance to the Flag was led by Mayor Atkins.
4. ROLL CALL:
Present: Councilmen- Dennis, Gillanders, Tyrell, Atkins
Absent: Councilmen- Merritt
Also Present City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Planning Director Dragicevich,
Parks and Recreation Director Kobett, Lt. Jeane
Robertson, Temple Station
Councilman Tyrell moved to excuse Councilman Merritt for cause,
seconded by Councilman Gillanders'and carried.
William Longwell, St. Christopher Council, Knights of Columbus, El Monte,
Ipresented a letter from Michael Paladin :, Grand Knight, commending City
Council on their action July 1, 1980, to adopt an ordinance relating to
the display of certain publications which could. be a detriment to the
children of the community.
Mayor Atkins accepted the commendation on behalf of the City Council,
stating that much of the credit should go to City Attorney Charles Martin
who drafted the ordinance.
5, CONSENT CALENDAR:
Councilman Tyrell moved to approve Items A through E on the Consent
Calendar as recommended, seconded by Councilman Gillanders and
carried:.

B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of October 28
(.I) RESOLUTION RELATING TO COUNTY SUBDIVISION ORDINANCE
Adopted Resolution No. 80 -1945 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY REGARDING SUBDIVISION STREET IMPROVE-
MENTS IN UNINCORPORATED AREAS OF LOS ANGELES COUNTY,
(2). PLANNING COMMISSION ACTION
Received and filed memo relating to action taken by the Planning
Commission at their regular meeting held October 28, 1980,
Council Minutes, November 4, 1980 - Page 2
C. APPROVAL OF FINAL MAP TRACT NO. 37579 (SEEMAN SCHOOL)
Approved the map; accepted streets and easements for dedication;
approved and accepted work agreements and bonds; found the project
will not violate any of the provisions of the Subdivision Map Act;
and instructed the City Clerk to endorse approval on the face of
the map.
D. RESOLUTION NO, 80 -1943: EMPLOYMENT OF PERSONNEL

E. RESOLUTION NO, 80 -1944: WARRANTS AND DEMANDS
Adopted Resolution No, 80 -1944 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$48,294.61, DEMAND NOS. 1006 THRU 1069.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: VACATION OF ALLEY - NORTH OF LAS TUNAS, SOUTH OF
ELM AVENUE BETWEEN ROSEMEAD AND SULTANA

City Manager Koski presented background information, stating the
City Council, at their regular meeting held October 7, 1980, adopted
Resolution No, 80 -1931 declaring its intent to vacate the alley
north of Las Tunas Drive, south of Elm Avenue, between Rosemead
Boulevard and Sultana Avenue. The alley is located in Area "D" of
the Rosemead Boulevard Redevelopment Project and it will be necessary
to vacate the alley in view of the pending development at the north-
east block of Rosemead Boulevard and Las Tunas Drive, Notices were
published and posted as required by the Streets and Highways Code.
City Council set public hearing November 4, 1980, to consider the
vacation of said alley.
Mayor Atkins declared the public hearing open and invited anyone
wishing to speak to come forward. There being no one come forward
to speak, Councilman Tyrell moved to close the public hearing, seconded
by Councilman Gillanders and carried.
Councilman Tyrell moved to certify the Negative Declaration of
Environmental Impact completed in conformance with the California
Environmental Quality Act and the State guidelines and instruct the
City Attorney to prepare.the appropriate resolution to be adopted
concurrently with the Agency approval of site development plans for
the theater complex, seconded by Councilman. Dennis and carried.
7 PUBLIC HEARING: ZONE VARIANCE CASE 584, CONDITIONAL USE PERMIT 589,
AND TENTATIVE TRACT 40737 - 10859 -61. E. FREER STREET
City Manager Koski gave staff report, advising the Planning Commission,
at their regular meeting held October 14, 1980, adopted a resolution
recommending the zone variance, conditional use permit, and Tentative
Tract No 40737.be approved., Subject property is located at 10859 -61
E. Freer Street with a 90 ft frontage and a depth of approximately
214 ft.. The proposed development would consist of five -unit condo -
minium, two stories :high . Because the Zoning Code requires 100 ft.
for two - story structures a : ;coe variance was requested, All other
aspects of the 1c; j ect meet the requirements of condominium develop-
ment. A drs.f Environmental Impact Report was prepared and submitted
in accordance with the Califc: nla Environmental Quality Act of 1970,

Councilman Dennis also stated he had talked with Mrs. Warren who
had objected at the Planning Commission meeting and had pointed
out that in conjunction with this development the long standing
problem of-standing water on.Freer Street would be corrected,
Councilman Tyrell moved to close public hearing, seconded by Council-
man Glllanders and carried,
Councilman Gillanders moved to incorporate a copy of the minutes into
the draft Environmental Impact Report, that the City Council certify
it has been completed in conformance with the California Environmental
Quality Act and the State guidelines and that Council has reviewed,
considered, and evaluated the information contained therein; that the
project is consistent with existing zoning and the general plan, and
that any adverse environmental impact contained in the report is
overruled and counterbalanced by economic and social needs, objectives,
and concerns in providing private or public improvements of municipal
import, seconded by Councilman Dennis and carried,
Councilman Dennis moved to approve Planning Commission Resolution
No. 80-916PC, seconded by Councilman Gillanders and carried,

NO, 6544 BY REFERENCE - ORDINANCE NO, 80-495 2nd read,
City Manager Koski advised that City Council, at their regular meeting
hold October 21, introduced Ordinance No, 80-495 adopting the County
Traffic ordinance by reference and set public hearing November. 4, 1980.
Certain provisions of the county ordinance have been deleted which
are outlined in Section 3300.
Mayor Atkins declared the public hearing open and invited anyone
wishing to speak to come forward, There being no one come forward
to speak, Councilman Tyrell moved to close public hearing, seconded
by Councilman Dennis and carried,
Councilman Tyrell moved to waive .further reading and adopt Ordinance
No. 80-495 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING PART A OF CHAPTER 3 OF ARTICLE III OF THE TEMPLE CITY
MUNICIPAL CODE, seconded by Councilman Gillanders and carried,
NEW BUSINESS
9, PROPOSED UNDERGROUND UTILITY DISTRICT
City Manager Koski presented, background information, stating the pro-
posed underground utility district comprises the Civic Center block
and such private owners as the Woman's club and the First United
Methodist Church.
Councilman Tyrell moved to set public hearing November 18,.1980,
to consider the proposed underground utility district, seconded by
Councilman Dennis and carried_
10. COMMUNICATIONS'
A. Temple City Unified School District r Request to hang banner
at Temple City. Boulevard and Las Tunas Drive - March 7=22, 1981.
Councilman Glanders moved to approve request from Temple City High
School fcr permissior . to hang a banner at Temple City Boulevard and
Las Tunas Drive, Mar,A 7-22, 1981, to advertise the annual musical
subject to the required Certificate of Insurance, seconded by Council-
man Dennis end carried,

City. Council instructed the City Attorney to review the code relating
to the repair, dismantling, or storage of vehicles on R -zoned properties.
Paul Jackson, 6221 Temple City Boulevard, stated he has complained
a out repair of vehicles in his neighbor's front yard and has not
been able to get anything done about it. Mr. Jackson was advised
staff would contact him in this regard.
RECESS TO CRA:
City Council recessed at 8 p,m. to meet as the Community Redevelopment
Agency, Mr, Merritt being absent; approved the minutes of the regular
meeting held October 21, 1980, and approved Conditional Use Permit granted
by the Planning Commission to the Kerkochian Inn. The minutes are set
forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:
12. ACTION ON REQUEST BY CRA:
There was no action to be taken.
13. MATTERS FROM CITY OFFICIALS:
A. Status Report: Property Nuisance Case No. 80 -55
6351 Temple City Boulevard
City Council received a staff report advising subject property
nuisance has been abated. Councilman Tyrell moved to terminate
proceedings, seconded by Councilman Dennis and carried.
B. Purchase of Laminating Equipment
Councilman Tyrell moved to approve the purchase of laminating
equipment, appropriate additional funds and amend the adopted
budget accordingly, seconded by Councilman Gillanders and carried.
C. Handling of Traffic Citation Collections
City Manager presented a memo advising the staff has considered a
number of options for the processing of traffic citations since the
Municipal Court will no longer accept parking citations until a
complaint is filed effective January 1, 1981.
City Council concurred with the direction staff is taking and re-
quested a final report for Council action at their regular meeting
to be held November 18, 1980.
D. Mayor Atkins advised he has appointed John Shaw to the vacancy
on the Parks and Recreation Commission. Councilman Tyrell moved to
confirm the appointment, seconded by Councilman Gillanders and carried.
E. Councilman. Dennis stated he would like to consider a..change in
the criteria for condominium development; that a number of zone vari-
ances have been granted to allow two- story structures on less than
100 ft. and he feels the ordinance should be reviewed with a view to
changing the lot width requirement.
Councilmen Gillanders, Tyrell, and Atkins disagreed and no action
was taken.
14. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Gillanders,
meeting adjourned at •8:10 p.m. Net regular meeting of the City
Council will* be held Tuesday, November 18, 1980, 7:30 p.m. in the
Council Chamber of the City Hall.
