AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING PORTIONS
OF CERTAIN EASEMENTS LOCATED ACROSS LOTS 25, 26 AND 27 OF CHAPEL HILL
COMMONS, SECTION THREE, AND ACROSS A TRACT OF LAND IN THE NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 4, TOWNSHIP 44 NORTH,
RANGE 12 WEST, IN THE CITY OFJEFFERSON, COLE COUNTY, MISSOURI.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Council finds that the following described easements are surplus
property of the City and are no longer needed for any public purpose:
A. Storm Water and Utility General Easement Description, Plat Book 12, Page 314.
All that part of a 15 feet wide Stormwater and General Easement across part of
Lots 25 and 26 of Chapel Hill Commons Section Three, as per plat of record in
Plat Book 12, page 314, Cole County Recorder's Office, said easement being a
strip of land 15 feet wide lying 7.5 feet each side of and adjacent to the following
described centerline: BEGINNING at the Southwest corner of Lot 25, thence
N68°40'31"E, 167.90 feet to the point of termination.
B. General Utility Easement Description, Plat Book 12, Page 314. All of that part of
a 15 feet wide General Utility Easement across part of Lots 26 and 27 of Chapel
Hill Commons Section Three, as per plat of record in Plat Book 12, page 314,
Cole County Recorder's Office, said easement being a strip of land 15 feet wide
lying 7.5 feet each side of and adjacent to the following described centerline:
BEGINNING at the Northwest corner of Lot 27, thence N50°12'31"E, 152.26 feet
to the point of termination.
C. Sanitary Sewer Easement Description, Plat Book 320, Page 432 and Plat Book
12, Page 314. Part of a 10 feet wide Sanitary Sewer Easement, recorded in Book
320, page 432, Cole County Recorder's Office lying across part of Lot 27 of
Chapel Hill Commons Section Three, as per plat of record in Plat Book 12, page
314, Cole County Recorder's Office; said easement being a strip of land 10 feet
wide lying 5 feet each side of and adjacent to the following described centerline:
From the Northwest corner of Lot 27, thence S37°05'53"E, 30.06 feet to the
POINT OF BEGINNING of said easement centerline; thence N85°55'29"E,
116.98 feet; thence N60°02'22"E, 79.72 feet; thence N20°43'27"E, 6.45 feet; to
the point of termination.
D. Sanitary Sewer Easement Description, Plat Book 11, Page 719 and Plat Book
12, Page 314. All of that part of a 15 feet wide Sanitary Sewer Easement, across
Part of Lot 7 of Dix Acres Section Two, as per plat of record in Plat Book 11,
page 719, Cole County Recorder's Office; said Sanitary Sewer Easement also
being across part of Lot 27 of Chapel Hill Commons, Section Three as per plat of
record in Plat Book 12, page 314, Cole County Recorder's Office; said easement
being a strip of land 15 feet wide lying 7.5 feet each side of and adjacent to the
following described centerline: From the Northwest corner of Lot 27, thence
S37°05'53"E, 156.88 feet; thence S52°54'07"W, 50.00 feet, to the POINT OF
BEGINNING of said easement centerline; thence S19°21'12"E, 17.00 fee to the
point of termination.
E. Sanitary Sewer Easement Description, Book 363, Page 948. All that part of a 15
feet wide Sanitary Sewer Easement as described in Book 363, Page 948, Cole
County Recorder's Office, being a strip of land 15 feet wide across part of the
Northeast Quarter of the Southwest Quarter of Section 4, Township 44 North,
Range 12 West, in the City of Jefferson, Cole County, Missouri, the centerline of
said 15 feet strip being more particularly described as follows: From the
northeast corner of the Southwest Quarter of said Section 4; thence
S85°52'02"W, along the Quarter Section Line, 283.35 feet; thence S37°05'53"E,
31.89 feet; thence S52°54'07"W, 10.0 feet to a point on the northerly line of a
tract of land described in Book 360, Page 269, Cole County Recorder's Office
and the POINT OF BEGINNING for the centerline of this easement description;
thence southerly, in a direct line, 131 feet to a point on the southerly line of said
tract of land described in Book 360, Page 269, Cole County Recorder's Office,
and the point of termination.
Section 2. The easements described in Section 1 are hereby relinquished, and the City
does hereby release and abandon whatever interest previously held in such easements.
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary
legal documents relinquishing all of the City's interest in the tracts of land described in Section
1.
Section 4. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
