CITY OF MEDINA
RESOLUTION NO. 9(,) - 4
RESOLUTION GRANTING FINAL
APPROVAL FOR A LOT DIVISION/COMBINATION
FOR DOUGLAS WALL AND JOSEPH MALCHOW
WHEREAS, Douglas Wall and Joseph Malchow (Applicants) have submitted
an application for a division and combination of property (Property) located
between the Applicants' lots, which Property is described in Exhibit A, attached
hereto; and
WHEREAS, the descriptions of the Applicants' properties after division and
combination of the Property are included in Exhibit B, attached hereto; and
WHEREAS, the proposed Property division/combination has been reviewed
by the planning commission and City Council for compliance with all City
ordinances and regulations pertaining to the subdivision of land.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the division/combination of the Property by the Applicants
is hereby given final approval, subject to the following:
1. The Applicants shall combine their respective portions of the Property with
their existing parcels;
2. The existing garage on the Wall portion of the Property shall be removed
within 180 days of the date of this resolution;
3. The Applicants shall grant to the City the drainage and utility easements
required by the city engineer;
4. The City urges Douglas Wall to take all reasonable steps to acquire the lot
to the north of his existing property from the DNR; and
5. The Applicants shall pay to the City for administrative expenses the amount
determined by the city staff to represent the actual cost to the City of
reviewing this application.
NOW, THEREFORE BE IT FURTHER RESOLVED by the City Council of the
City of Medina that the following variances be granted:
1. Reduce minimum lot size form 9,000 square feet to 8,669 square feet for
the portion of the lot to be purchased by Douglas Wa11; and
2. Reduce front yard setback from 30 feet to 17.8feet for the garage
on the grounds that the neighborhood standard for lot size is 6,000 square feet and
that the placement of the existing house constitutes a hardship to the Property.

The motion for the adoption of the foregoing resolution was duly seconded by

Those parts of Lot 3 and Lot 4, and that part designated as "Beach", all
in Block 8, "Independence Beach, Hennepin County, Minnesota", according
to the recorded plat, thereof, Hennepin County. Minnesota described as
commencing at the most easterly corner of Block 8 in said addition; thence
northwesterly along the northeasterly. line of said Block 8 a distance of
298.96 feet to its intersection with a line drawn parallel with and 6.0t1
feet southeasterly measured at right angles from the northwesterly line of
said Lot 4, said point being the point of heginning of the land to he
described said point being marked by a Judicial Landmark; thence continuing
northwesterly along'said northeasterly line of Block 8 to a point 25.00
feet southeasterly of the northeast corner of said Lot 3; thence
southwesterly. passing through a point on the southwesterly line of said
Lot 3 distant 25.00 feet southeasterly of the northwest corner of said
Lot 3 to the shore of Lake Independence; thence southeasterly along said
shoreline to its intersection with a line drawn southwesterly from the
point of beginning and parallel with the northwesterly line of said Lot. 4;
thence northeasterly along said parallel line passing through a Judicial
Landmark located 119.55 feet southwesterly of the point of beginning to
the actual point of beginning. Said Judicial Landmarks were set pursuant
to Torrens Case No. 10454.
PROPOSED WALL DESCRIPTION:
The southeasterly front and rear of Lot 2, Block 8, "Independence Beach,
Hennepin County, Minnesota." ALSO that part of the tract of land
designated as "Beach" on the plat of "Independence Beach, Hennepin County,
Minnesota", lying between the northwesterly line and the southeasterly line
of the southeasterly 'S of Lot 2, Block 8, "Independence Beach, Hennepin
County, Minnesota", extended southwesterly to the shore of Lake Independence,
according to the recorded plat _thereof, and situate in Hennepin County,
Minnesota.
That part of Lot 3, and that part designated as "Beach", all in Block 8,
"Independence Beach, Hennepin County, Minnesota," according to the recorded
plat thereof, Hennepin County, Minnesota described as beginning at the
northeast corner of said Lot 3 being marked by,a Judicial Landmark; thence
southeasterly along the northeasterly line of said Lot 3 a distance of
25.00 feet; thence southwesterly passing through a point on the
southwesterly line of said Lot 3 distant 25.00 feet southeasterly of the
northwest corner of said Lot 3 to the shoreline of Lake Independence;
thence northwesterly along said shoreline to its intersection with the
southwesterly extension of the northwesterly line of said Lot 3, said•
line being marked by Judicial Landmarks set pursuant to Torrens Case
No. 10454; thence northeasterly along said southwesterly extension and
the northwesterly line of said Lot 3, to the point of beginning.
