AB 14X -UTILITY USER'S TAX: GAS AND ELECTRICITY Comments: Existing law in the. State of California, allows local jurisdictions to impose a utility user's tax. The utility user's tax is based on the consumption of electricity, gas, water, sewer, telephone, and cable television services. The revenue from these taxes goes into the general fund of the local agency. AB 14X would require that every local jurisdiction that levies a utility user's tax base the tax for residential and small commercial customers on a per unit usage basis and not on the price per unit. In addition, the usage rate could not exceed the rate paid by consumers in~January 2000. Recommendation: Staff respectfully requests that the Board of Directors of the Lynwood Public Finance Authority receive and file the information. AUTHORITY SPECIAL MEETING APRIL 23, 2001 The Public Finance Authority of the City of Lynwood met in a Regular Meeting at 11330 Bullis Road on the above date at 9:07 a.m. President Richards presiding... Members Byrd, Rea, Reyes, and Richards answered to roll call for all agencies. Vice President Sanchez was absent. Also present were Chief 'Administrative Officer Davis, City Attorney Thever, Secretary Hooper and Treasurer Pygatt. PUBLIC ORAL COMMUNICATIONS (AGENDA ITEMS ONLY) NONE PUBLIC ORAL COMMUNICATIONS NONE Item #4: .Strategic Plan & Implementation Citizen of the Month Program President Richards asked that Members be included in the nomination of Citizen of the Month as well as Employee.ofthe Month. Chief .Administrative Officer Davis discussed the Employee of the Month Program. After further discussion, it was moved by Member Reyes, seconded by Member Byrd and carried to receive and file the information. Public Works .Update on the Capital Improvement Projects Public Works Director Joe Wang gave a brief overview of CIP Projects and the Civic Center Master Plan. Director Wang introduced the West Group Architects working on the Master Plan.. The West Group Architects presented Members with various themes and options for a new Civic Center. Asked Members for further direction.. President Richards suggested using the entire area,. from Martin Luther King Blvd. to the Armory as the Civic Center. Also suggested creating a "Civic Center Authority" as a separate board that would look at issues such as approaches. to financing and. possible new revenue streams. Assistant Public Works Director Yadi Fahardi discussed upcoming CIP Projects and distributed a list of projects and timeframes to Council. Yadi. discussed the following projects: • Street Improvements . • Water /Sewer Improvements • Building Improvements ` - . • Special Projects Member Rea stated he is opposed to any designs on median islands, and objects to any additional islands being proposed in the city, especially on Imperial Highway. Suggested more landscaping, parkway improvements and trees. Stated the lack of maintenance to maintain the medians just creates a waste of dollars and- cents. Also discussed the widening of sidewalks on Long Beach Blvd. President Richards stated the medians on Long Beach Blvd. are a breath of fresh air, and' we also need to look into improving the aesthetics of the businesses on . Long Beach Blvd. Stated we have the resources to do the work. Member Byrd wants fencing on medians at schools to deter people from running across the streets. Discussed the maintenance of median islands and the obstructive light standards on the sidewalk on Long Beach Blvd. Public Works Director. Wang explained the reason. for the standards ultimately being installed on the sidewalk on Long Beach .Blvd.. President Richards asked staff to contact Edison with regard to the south end of the city. Stated it is extremely dark on the south end at night. President Richards also discussed possibly using stamped concrete instead of landscaping to alleviate the problem of weeds and shrubbery. Member Rea suggested applying for exemptions through ADA to repair sidewalks. Yadi discussed reconstruction and the ADA rules. Member Rea asked about delays and .how long is our warranty on streets after construction. Yadi stated the warranty is one year. Member Rea asked if the city could get a 2-year extension instead of 1 (one). Member Rea also discussed current failed streets and .potholes in streets constructed two (2) years ago. Member Rea will provide staff with a list of streets in disrepair. Recreation & Community Services Staff distributed to Members drafts of the redesigned city Anniversary Logo. Strategic Plan and Implementation PUBLIC WORKS Public Works Director Joe Wang and Assistant Public Works Director Yadi Fahardi continued their presentation on Capital Improvement Projects (CIP's). • CLP PROJECTS Yadi presented Members with a brief overview of the following CLP Projects: o Natatorium Update o Ham Park Teen Center o Water Main Upgrade o Teen Square Project o Water Tower Project Public Works Director Wang stated that Public Works is moving more aggressively with the C1P Projects. Stated. several streets have been designed and are ready to advertise, but the problem is that Public Works does not have an adequate number of Inspectors for the projects. Member Rea asked Joe to bring back a recommendation for Members to consider hiring an additional inspector. Chief Administrative Officer Davis asked for permission to negotiate with private contractors for a temporary inspector. The presentation covered the following topics: _ • City-Wide Clean-Up Campaign o Divide city into 13 areas o Outreach Education Program o Publicity & Community Education o Clean-up and Beautification o Residential Participation o Tima Frames o .Clean-up Schedule PUBLIC SAFETY -SHERIFF'S DEPARTMENT DUI Checkpoints Sergeant Jaen. and Deputy Mike Metcalf presented Members with an overview of the Checkpoint Program. Stated these checkpoints are to increase public awareness, cite and arrest violators, reduce traffic collisions, and make streets safe. Herek presented Members with information pertaining to public and portable scales. Lt. Herek listed the .pros and ccns of public versus portable scales. Member Rea left at 9:50 a.m. 2 • ~ i PUBLIC WORKS Imperial Highway Project Public Works Director Wang discussed the design and median- islands for the Imperial Highway project. Discussed letter sent to school district regarding the proposed fence in front of .the front entrance of the school. No response. Distributed to Council a cost estimate for the redesign. Discussed upcoming bid opening for the project. Vice President Sanchez discussed the need for a fence on Imperial Highway and stated that the landscaping will last longer with a fence on the median island. President Richards discussed improving the area at Imperial and Norton. Director Wang also discussed pavement lights for the Bullis Road crosswalk Chief Administrative Officer Davis discussed the $50,000 reward recently offered by the Governor for information leading to the conviction of the murder of Gary Beverly, and _the ceremony still pending regarding the renaming of the street in front of the high school .Public Works Director Wang stated that the sign has been prepared and is ready for installation. President Richards requested staff move forward with the street dedication and set a date for the ceremony. Member Rea stated that he is not happy with the Code .Enforcement Officers he .believes they are not,completing there job tasks. Community Development Director Gary Chicots stated he would bring back to Council ` more information and guidelines. Adams, Project Manager SUBJECT: AB 14X -Utility User's Tax: Gas and Electricity PURPOSE: To have the President 8~ Members of the Lynwood Public Finance Authority receive and file this item. BACKGROUND: Existing law in the -State of California, allows local jurisdictions to impose a utility user's tax. The utility user's tax is based on the consumption of electricity, gas, water, sewer, telephone, and cable television services. The revenue from these taxes goes into the general fund of the local agency. Utility companies levy the tax on behalf of the local jurisdiction on their regular utility bills and then send the revenues to the agency: Utility user taxes are currently collected on a cost based system which means that they are collected based on the dollar amount of a utility bill, not based on the total units of consumption. ANALYSIS: Utility prices are currently rapidly rising in the areas of electricity and natural gas. The legislature feels that local jurisdictions are reaping the windfall of higher .utility bills by collecting a higher amount of utility user tax revenues. AB 14X (Matthews) This legislation was introduced in an attempt to prevent cities and counties from being able to benefit by the increased costs to consumers of electricity and natural gas. AB 14 X would require that every local jurisdiction that levies a utility user's tax base the tax for residential and small commercial customers on a per unit usage basis and not on the price per unit. In addition, the usage rate could not exceed the rate paid by consumers in January 2000. Local jurisdictions are not really reaping any benefits of the increased electricity and natural gas rates because their rates are being increased just like the rates of consumers and businesses. The Assembly Local Government Committee will next hear AB 14X some time in May. RECOMMENDATION: Staff respectfully requests that the President & Members of the Lynwood Public Finance Authority receive and file this item. This bill would require any local utility user's tax, imposed on the consumption of gas or electricity, or both, to be imposed on a per unit of usage basis. The bill would make legislative findings and .declarations, and express the intent of the Legislature, in that regard. By revising the method that local agencies would be required to use to calculate existing taxes, the bill would impose a _ state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement, including the creation of a State Mandates Claims Fund to pay the costs of mandates that do not exceed 51,000,000 statewide and other procedures for claims whose statewide costs exceed 51,000,000. Section 7284.5 is added to the Revenue and Taxation Code, to read: 7284:5. (a) (1) The Legislature finds and declares that basing the amount of a utility user's tax on the usage of gas and electricity will reduce the potential for excessive tax increases, and will provide an incentive to reduce consumption. The Legislature further finds and declares that the regulation of the utility user's tax on gas and electricity is a matter of statewide concern because of the rising costs of providing energy to California's consumers. (2) It is the intent of the Legislature that local jurisdictions that impose utility user's tax on gas and electricity not collect - windfall profits as a result of increased energy costs, but instead stabilize tax rates for ratepayers of gas and electrical services - without reduction of revenues to the local jurisdictions. It is the further intent of the Legislature that the effective rate of the tax paid on a per unit of usage basis as a result of this section be no greater than the effective rate paid by consumers in January 1, 2000. (b) Every local jurisdiction, as defined in subdivision (c), that levies a utility user's tax on gas or,electricity, or both, shall base. its utility user's tax rate on a per unit of usage basis, and not upon the price per unit of usage. The per unit of usage rate established by the local jurisdiction under this section may not exceed the effective per unit of usage tax rate paid by taxpayers in January 2000. (c) .For purposes of this _section, "local jurisdiction" means any city, county, city and county, including any chartered city or city .and county, district, or public or municipal .corpora ti on. SEC. 2. Notwithstanding Section 17610 of the Government Code, if the. Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code. If the statewide cost of the claim for reimbursement does i~ot exceed one million dollars (51,000,000), reimbursement shall be made from the State Mandates Claims Fund.
