HomeMy Public PortalAbout1990-51Member adoption: r/. introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 67 n / RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO HOLIDAY STATIONSTORES, INC. WHEREAS, Holiday Stationstores, Inc. (Applicant) has applied for a conditional use permit for a gasoline and convenience store at 1300 Co. Rd. 29 (the northwest corner of Highway 12 and Co. Rd. 29); and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the matter has been reviewed by the planning commission on June 12, 1990, and by the City Council on July 3, 1990; and WHEREAS, it has been determined that the existence of the proposed gasoline and convenience store totaling 3,600 square feet will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. There shall be no propane tank filling or waste oil collection on site; 2. The Applicant shall be allowed to display merchandise on the sidewalk; 3. The building shall be constructed in compliance with City performance standards and shall have brick on all four sides; 4. All signs shall meet City ordinance requirements; 5. Site elements, including exterior trash containers, rooftop mechanical equipment and parking areas shall be screened in compliance with City ordinance requirements; 6. The Applicant shall construct the parking areas and install landscaping in accordance with City requirements; 7. The Applicant shall install concrete curbs and sidewalks and shall use concrete or blacktop to pave the remainder of the hard cover portions of the site in accordance with City requirements; 8. It is acknowledged that the proposed site plan complies with the City's hard surface ratio; 9. Hours of operation may be up to 24 hours per day, seven days per week; 10. The number of employees on site shall not exceed six at any one time; 11. All exterior lighting shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and that no light is cast directly on any other property or right-of-way; 12. Site drainage, access and construction of site elements shall be accomplished in compliance with the requirements of the city engineer as expressed in his letter of June 8, 1990, attached hereto as Exhibit A; 13. The Applicant may use the on -site loudspeaker for emergency or safety announcements but shall not use it to broadcast entertainment or advertising messages; 14. The building shall be reviewed by the fire department; 15. The Applicant must obtain approval of the plan for site drainage from the watershed district; 16. The Applicant shall construct the access road from Co. Rd. 29 to the east property line to a 9 ton capacity, with the road being a mirror image of the road on the Dairy Queen site immediately to the north and with two 35' entrances each; 17. The Applicant shall submit a revised site plan showing access road right-of-- way extending from Co. Rd. 29 to the east property line; 18. There shall be no vehicle repair work performed on site; 19. The Applicant shall comply with the requirements of the Minnesota pollution control agency and the state fire marshal regarding underground fuel storage; 20. There shall be city sewer but water supplied by a private well on the site. The number of SAC units shall be determined by city staff; 21. Future underground tanks shall be handled by city staff in accordance with the plans submitted; 22. The Applicant shall conform with all state health code requirements; 23. The Applicant shall dedicate to the public any right-of-way for Highway 12 or Co. Rd. 29 determined to be needed by the city engineer. 2 24. The Applicant shall execute a development agreement in a form acceptable to the city attorney and post security in the amount of $87,802.50 to ensure completion of all site work; 25. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application; and 20. Any violation of the terms of this conditional use permit or any land use regulation of the City related thereto shall be grounds for revocation of this conditional use permit. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota, that the following variances be granted on the grounds that the topography and configuration of the lot and safety concerns regarding the intersection constitute hardships to the property: 1. reduce the rear yard setback for the building from 30' to 17'; 2. reduce the front yard setback for the south end of the canopy from 150' to 13 5'; and 3. reduce the front yard setback for the north end of the canopy from 50' to 3 7'.
