WHEREAS, the Public Lands Highways Discretionary (PLHD) funds are available for transportation planning, research, engineering and construction of highways, roads, parkways and transit facilities that are within or adjacent to Federal Public land; and WHEREAS,the PLHD program is administered by the Federal Highway Administration's Federal Lands Highway, and the funds are available for any kind of transportation project eligible for Title 23 of United State Code; and WHEREAS,eligible programs are funded 100% ,and could provide the City with funds to improve efficiency of the City's transportation system, and complete NW 143rd Street Stormwater Drainage and street improvement; and WHEREAS, the City Commission of the City of Opa-locka,authorizes the City Manager to submit an application for funds to the U.S. Department of Transportation, Federal Highway Administration, for FY 2012 Public Lands Highways Discretionary Program (PLHD). NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Resolution No. 11-8317 Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby authorizes the City Manager to submit an application to the U.S. Department of Transportation, Federal Highway Administration,for the FY 2012 Public Lands Highways Discretionary(PLHD)Program,requesting funds in an amount up to Seven Hundred Fifty Thousand ($750,000) Dollars. Request: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION TO THE FLORIDA DEPARTMENT OF TRANSPORTATION, FEDERAL HIGHWAY ADMINISTRATION, FOR THE FY 2012 PUBLIC LANDS HIGHWAYS DISCRETIONARY (PLHD) PROGRAM REQUESTING FUNDS IN THE AMOUNT UP TO SEVEN HUNDRED AND FIFTY THOUSAND ($750,000.00) DOLLARS; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. Description: The Public Lands Highways Discretionary (PLHD) Program provides funding transportation planning, research, and engineering and construction of highways, roads, parkways and transit facilities that within, adjacent to, or provide access to Indian reservations and Federal public lands including nation parks, refuges, forest, recreation areas and grasslands. Eligible public sector organizations can request funding for engineering surveys and investigations; economic surveys and investigations; planning of future FLMA transportation program; planning of future FLMA public transportation systems; planning of the financing of future FLMA highway and public transportation systems; FLMA transportation planning and coordination with metropolitan and statewide transportation planning; development and implementation of FLMA management systems, including such activities as traffic data collection and analysis, pavement and bridge inspections and safety audits; studies of the economy, safety and convenience of surface transportation systems; and studies of the desirable regulation and equitable funding of surface transportation systems. Financial Impact: Funding for the costs of any project eligible under this program is 100 percent. Implementation Time Line: Immediately. Application due date is December 21, 2011. Legislative History: None Recommendation(s): Staff is recommending the approval. A successful application will provide the City with funds to improve the efficiency of the city's transportation system. The funds will be used to complete the NW 143rd Street stormwater drainage and street improvement project. NW 143rd Street is the access road to Segal Park. The NW 143rd Street project has some grant funds which allow construction of drainage and roadway improvement for a smaller portion of the roadway than the original intent of the construction plan. The additional funds will allow the city to complete the construction of this project as it was originally designed. The use of Standard Forms 424, 424A, 424B, 424C, 424 D, and SF-LLL has been approved by the Office of Management and Budget under the respective control numbers 0348-0043, 0348-0044, 0348-0040, 0348-0041, 0348-0042, and 0348-0046. Notwithstanding any other provision of law, no person is required to respond to, nor shall any person be subject to a penalty for failure to comply with, a collection of information subject to the Paperwork Reduction Act, unless that collection displays a currently valid OMB control number. Public reporting burden for this collection of information is estimated to average 80 hours per response, including the time for reviewing instructions, searching existing data sources, gathering and maintaining the data needed, and completing and reviewing the collection of information. Public Lands Highways Discretionary (PLHD) Program Description The Public Lands Highway Discretionary (PLHD) Program is described in 23 U.S.C. §§ 202, 203, and 204, and has been reauthorized and continued through March 31, 2012. The program is administered by the Federal Highway Administration's Federal Lands Highway Office. PLHD funds are available for any kind of transportation project eligible for assistance under Title 23, United States Code, that is within, adjacent to, or provides access to Federal lands or facilities. PLHD funds are available for transportation planning, research, engineering, and construction of the highways, roads, and parkways, and of transit facilities within the Federal public lands. PLHD funds are also available for operation and maintenance of transit facilities located on Federal public lands. Entities Eligible to Apply for Funding State departments of transportations may apply directly and, Federal Land Management Agencies, metropolitan planning organizations, local governments, and tribal governments may apply through States as sub-recipients. Under the provision of 23 U.S.C. § 202(b)(1)(A), the funds shall be allocated "among those States having unappropriated or unreserved public lands, nontaxable Indian lands or other Federal reservations, on the basis of need in such States." Since all of the States have some Federal lands, all are eligible to apply for PLHD funding.
