AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A
SETTLEMENT AGREEMENT WITH COLE COUNTY MISSOURI PERTAINING TO
UNPAID SURTAX
WHEREAS, The County of Cole and the County Collector were obligated to collect and
distribute surtax money payable as provided in § 139.600, RSMo; and
WHEREAS, Due to an inadvertent error in 1989, the City of Jefferson has not been
receiving all of the disbursements which it should have received; and
WHEREAS, The parties have agreed that it is in their mutual best interests to resolve this
matter without formal litigation.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council hereby authorizes and directs the Mayor and City Clerk
to execute a settlement agreement with the County of Cole and the Cole County Collector
for an amount not less than $751,056.46 to be paid over a period of not more than 15
years, without interest, and substantially in the form of the attached Exhibit A.
Section 2. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
