I. DESCRIPTION OF THE AMENDMENT
The request has been initiated by the City of Tybee Island for a text amendment dealing with private
parking lots. A request has been made requesting consideration of changing the current ordinance which
allows private parking lots to charge for parking on specified holidays regardless of zoning.
II. WHY THE AMENDMENT IS BEING PROPOSED
The applicant, the City of Tybee Island, is requesting the amendment to increase the period of time during
which private parking lots may operate in an effort to provide additional parking for visitors to the island
and as an economic development initiative supporting small business in the community.
STAFF FINDING: Staff drafted the attached proposed text amendment dated 07/13/09 in response to a request by
Planning Commission at their June 16, 2009. Because the private parking lot raises significant questions and
concerns about the intrusion of commercial uses and potential nuisances into residential areas it is recommended
that private parking lots operating year -round and sited in residential zones and/or bordered by residential uses be
buffered by a vegetative hedge of at least 10 feet. If private parking lots, whether seasonal or year -round are to be
considered in any zoning district it is strongly recommended that they be subject to the requirements for special
review and public hearings. Special review and site plan applications are charged review fees of $250 each for a
total review fee of $500. A valid survey may be an additional cost. Because this use is a potential nuisance and is
clearly an intrusion of commercial uses into a residential district it is important that neighbors be notified and given
the opportunity to comment on the application during a public hearing.

AN ORDINANCE TO AMEND THE CODE OF ORDINANCES
SECTION 34 -3 PERTAINING TO PRIVATE PARKING LOTS
FOR THE CITY OF TYBEE ISLAND, GEORGIA
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, and
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is the Mayor and Council thereof, and
WHEREAS, the governing authority desires to adopt ordinances under its police, zoning,
and home rule powers,
WHEREAS, it is necessary to amend the Code of Ordinances pertaining to private
parking lots so as to expand the times of use permissible for such so that the following changes
shall be made in Section 34 -3.
NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee
Island that Code Section 34 -3 regarding private parking lots is amended so as to hereafter
provide as follows:
Section 34 -3 Private Parking Lots
Notwithstanding any other ordinance or provision to the contrary, individuals owning
property suitable for vehicular parking may apply to the city for a business license so as to
authorize them to charge for parking on their property, regardless of the zoning of the property
so long as the property abuts a public road, during such times as may be established by the
Mayor and Council or authorized City staff. In general those times shall be in connection with
special events or holiday weekends or holidays and the heavy tourist season and shall include all
dates from St. Patrick's Day through Labor Day and such license shall authorize the holder
thereof to rent out parking spaces solely on the holder's property between the hours of 08:00 a.m.
and 09:00 p.m., or the duration of the event, the weekend or holiday, all as stated on the license.
It shall be unlawful to rent spaces in any district without a valid business license issued by the
City of Tybee Island.

location showing the parking spaceskhat will be rented. Upon submittal of the applications and
all pertinent materials, the Mayor and Council will hear the request for application at their next
regularly scheduled meeting of the City of Council. Public comments, if any, will be allowed to
be made at these meetings and allow for property notification to adjacent property owners of the
application.
Each license to operate a private parking lot on Tybee Island will be subject to an annual
review for compliance. If compliance is not met, the license may be revoked by City Council
upon a hearing that will take place during a regularly scheduled City Council meeting.
It is the intention of the governing body, and it is hereby ordained, that the provisions of
this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island,
Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such
intention.
This ordinance shall be become effective on day of , 2010.

At a meeting on May 28, 2009, City Council voted to approve allowing existing residentially -zoned private
parking lot operators to operate under enclosed proposed ordinance 10- 2009 -B until Labor Day of 2009.

ARTICLE I. IN GENERAL

Section 34 -3, Private Parking Lots
Residential and commercial. Notwithstanding any other ordinance or provision to the contrary,
in all zoning districts private parking lots are permitted only after site plan (Land Development
Code Sec. 5 -080) and special review (Land Development Code Sec. 5 -070) by the Planning
Commission, a public hearing has been held by the Mayor and Council, and the Mayor and
Council has determined that the use is appropriate. Individuals owning property suitable for
vehicular parking must present such applications accompanied by a statement of the hours of
operation and a valid survey depicting, among other things, the present location of all property
lines and structures on the property. In addition, the proposed parking spaces and drive aisle(s)
shall be delineated on the survey in compliance with off - street parking dimensions (Land
Development Code Sec. 3 -080). If bordering a residential use, a delineated vegetative buffer of
10 (ten) feet from all affected property lines shall be shown on the survey for all parking spaces
and drive aisle(s). At the discretion of the Mayor and Council, a 6 (six) foot tall solid fence may

Sec. 34 -3. Private parking lots.
Notwithstanding any other ordinance or provision to the contrary, individuals owning property suitable
for vehicular parking may apply to the city for a permit so as to authorize them to charge for parking on their
property, regardless of the zoning of the property, during such times as may be established by the mayor and
council or authorized city staff. In general, those times shall be in connection with special events or holiday
weekends or holidays and include July 3, July 4, Mother's Day, Father's Day, the Tybee Marathon, Memorial
Day and Labor Day, and such permit shall authorize the holder thereof to rent out parking spaces solely on
the holder's property between 8:00 a.m. and 9:00 p.m. or the duration of the event, the weekend or holiday, all

accomplished nothing else, I think we all realize that this is a bigger and more complicated

I. DESCRIPTION OF THE AMENDMENT
The request has been initiated by the City of Tybee Island for a text amendment dealing with private
parking lots. A request has been made requesting consideration of changing the current ordinance which
allows private parking lots to charge for parking on specified holidays regardless of zoning to one of the
two following options:
A. Amending the current ordinance to allow private parking lots to operate in connection
with special events, holiday weekends or holidays and the heavy tourist season
between St. Patrick's Day and Labor Day regardless of zoning. Parking would be
permissible between 8:00 a.m. and 9:00 p.m. or the duration of the special event,
holiday or weekend (proposed Ordinance 10- 2009 -B)
B. Amending the current ordinance to allow private parking lots to operate year -round
regardless of zoning. Parking would be permissible between 8:00 a.m. and 9:00 p.m.
(proposed Ordinance 11- 2009 -A)
II. WHY THE AMENDMENT IS BEING PROPOSED
The applicant, the City of Tybee Island, is requesting the amendment to increase the period of time during
which private parking lots may operate in an effort to provide additional parking for visitors to the island
and as an economic development initiative supporting small business in the community.
STAFF FINDING: Staff finds that the proposed text amendment raises significant questions and concerns about
the intrusion of commercial uses and potential nuisances into residential areas. It is strongly recommended that
private parking lots operating year -round and sited in residential zones and/or bordered by residential uses be
buffered by a vegetative hedge of at least 10'. If private parking lots, whether seasonal or year -round are to be
considered in any zoning district it is strongly recommended that they be subject to the requirements for special
review and public hearings. Special review and site plan applications are charged review fees of $250 each for a
total review fee of $500. Because this use is a potential nuisance and is clearly an intrusion of commercial uses into
a residential district it is important that neighbors be notified and given the opportunity to comment on the
application during a public hearing.

Chair James Boyle opened a Public Hearing for a proposed Text Amendment to Municipal Code Section
34 -3, Private Parking Lots. Proposed Ordinances 11 -2009A and 10- 2009 -B were included in the
Commissioners' packets. City Council had referred the matter to the Commission for recommendation
on whether to impose additional regulations on private parking lots including buffer requirements,
capacity limitations, specifications for parking spaces, requiring Site Plan, requiring Special Review,
safety, and regulating the types of vehicles which may be served. Dianne Otto explained that Section 34-
3 allowed private parking lots to operate from 8:00 am to 9:00 pm on certain holiday and special event
weekends. She said that Council elected to adopt 10- 2009 -B for the remainder of 2009 for existing,
licensed parking lots, and the change allowed them to operate from St. Patrick's Day through Labor
Day, on any days, not just special weekends. Otto referred the Commissioners to a list of licensed lots
included in their packets. She said that they were addressing the residentially zoned lots and there were
currently three. Through explanation by Otto, discussion among the Commissioners, comments by
Downer Davis (the City's consulting engineer), and public input by Marianne Bramble (operator of a
residentially -zoned parking lot), the following topics related to private parking lots were identified:
• Extending the time to later than 9:00 pm,
• Including Pirate Fest (October), Christmas Parade (December), Mardi Gras (February) events,
• Potential loss of City parking revenue,
• Year -round operation versus seasonal versus periodic,
Private lots supplementing the amount of parking available,
• Annual business license fee of $135,
• One -time Site Plan fee of $250 and one -time Special Review fee of $250,
• Staff review versus Public Hearing notification requirements,
• Vegetative or fence buffering, setback requirements,
Commercial versus residential zones,
Parking surface sustainability, dust, bare soil,
Standardized size of parking spaces, drive aisles, density,
• Neighbors, property values,
• Illegally parked vehicles.
It was determined that Staff would return the following month with recommendations regarding
commercial versus residential private parking lots. No action was taken.

Mayor Buelterman called the regular meeting of the City Council to order at 7:OOpm. Those
present at the Consent Agenda were also in attendance for the regular meeting.
Consent Agenda:
• Consideration of Consent Agenda Items.
A Motion by Councilman Wolff to approve was seconded by Councilman Smith. The vote was
unanimous.
Consideration of Ordinances, Resolutions:
• 1 Reading on Ordinance 12 -2009 to Amend Sec 42 -60(5) the Code of Ordinances Pertaining to
Litter and to add a new section to be designated as Section 42 -64 for Penalties for Littering.
A Motion by Councilman Wolff to approve for 1 reading with the addition of Parking Lots and
Parks and defining rubbish as whether it's biodegradable or not was seconded by Councilman
Brewer. The vote was unanimous.
• 1 Reading on Ordinance 11 -2009 to Amend Code of Ordinances Pertaining to Litter on
Municipal Beaches to add subsection 12 -1(e) Penalty for Litter to Section 12 -1.
A Motion by Councilman Wolff to approve was seconded by Councilman Smith. The vote was
unanimous.
• 1 Reading on Ordinance to Amend Code of Ordinances Sec 34 -3 Pertaining to Private Parking
Lots
Option B: Specifies- In connection with special events or holiday weekends or holidays and the
heavy tourist season and shall include all dates from St. Patrick's Day through Labor Day.
A Motion by Councilman Smith to approve option B specific to those that have existing parking
business licenses and send to Planning Commission for review was seconded by Mayor pro tem
Doyle. The vote was unanimous.
Executive Session:
A Motion by Councilman Smith to go into Executive Session to discuss Personnel, Real Estate
and Litigation was seconded by Councilman Brown. The vote was unanimous.
A Motion by Councilman Wolff to return to regular session was seconded by Councilman Brown.
The vote was unanimous.
Adjournment:
A Motion by Councilman Wolff to adjourn was seconded by Councilman Smith. The vote was

CITY OF TYBEE ISLAND CURRENT
MUNICIPAL CODE ORDINANCE
ARTICLE I. IN GENERAL
Sec. 34 -3. Private parking lots.
Notwithstanding any other ordinance or provision to the contrary, individuals
owning property suitable for vehicular parking may apply to the city for a permit
so as to authorize them to charge for parking on their property, regardless of the
zoning of the property, during such times as may be established by the mayor and
council or authorized city staff. In general, those times shall be in connection with
special events or holiday weekends or holidays and include July 3, July 4, Mother's
Day, Father's Day, the Tybee Marathon, Memorial Day and Labor Day, and such
permit shall authorize the holder thereof to rent out parking spaces solely on the
holder's property between 8:00 a.m. and 9:00 p.m. or the duration of the event, the
weekend or holiday, all as stated on the permit. It shall be unlawful to rent spaces
in any district other than commercial, except as specifically authorized herein.

It is the intention of the governing body, and it is hereby ordained, that the provisions of
this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island,
Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such
intention.
This Ordinance shall become effective on day of , 2009.
