HomeMy Public PortalAbout1990-551 i Member adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 1') ``� RESOLUTION GRANTING A VARIANCE FOR WILLIAM REED WHEREAS, the William Reed (Applicant) has requested a variance to reduce the required front yard setback from 30 feet to 25 feet to construct an attached garage on his house at 2732 Morningside Road; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding its request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance to reduce the front yard setback for an attached garage from 30 feet to 25 feet is granted, subject to the following conditions: 1. The Applicant may blacktop the area in front of the new garage but may not extend the blacktop to the street; 2. There shall be no change in the curb cut; 3. The Applicant shall relocate the fence along the east property line immediately upon commencement of construction of the new garage; I1 4. The Applicant shall remove the metal shed in the northeast corner of the lot within one year of the issuance of a building permit for the garage addition and shall post with the City security in the amount of $500 to ensure removal of the shed; and 5. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this variance application. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted is justified by the fact that this is a corner lot subject to two front yard setbacks and because of the location and angle of the existing house.
