HomeMy Public PortalAboutORD14747 SUBSTITUTE BILL NO. 2010-86 SPONSORED BY COUNCILMAN y /� Harvey ORDINANCE NO. / �-f / '/ 7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ELECTING THE L-11 RETIREMENT BENEFIT OPTION WITH THE MISSOURI LOCAL GOVERNMENT EMPLOYEES RETIREMENT SYSTEM FOR FIRE SERVICE EMPLOYEES WHO ARE NOW SOCIAL SECURITY EMPLOYEES. WHEREAS, The City of Jefferson, Missouri, hereby declares its desire to include all its eligible Firemen (as defined by Section 70.605(13)),except those who have already been enrolled in the retirement system provided by the Missouri Local Government Employees Retirement System (hereinafter LAGERS), to LAGERS; and WHEREAS, It is declared to be the policy of the City of Jefferson, a political subdivision as defined by section 70.600, RSMo.,to consider as eligible for coverage all current and future Firemen (Section 70.605(13)) who are eligible by state law; and WHEREAS, It is also declared that the Firefighters of the City of Jefferson do not participate in the federal Social Security program. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. All present and future Fire Department employees, not already members of LAGERS, declared to be eligible, who have 1,500 or more hours of annual employment, shall be covered under Benefit Program L-11 (2.50% for life). This provision shall apply only to fire service employees who are non-social security employees, all others shall remain in the LAGERS L-6 program. Section 2. "Final Average Salary"for each employee shall be determined on the basis of a thirty-six (36) consecutive month period (Section 70.656 RSMo.). Contributions to the Missouri Local Government Employees Retirement System of 4% total gross wages shall not be required from eligible employees. Section 3. All eligible employment after the effective date shall be considered membership service, as defined in 70.600(15) RSMo. Section 4. All prior service with the City of Jefferson shall be included when calculatina benefits and eligibility and the City shall purchase the same. . Section 5. The city is directed to deduct from the wages and salaries of each eligible Fire Department employee member, the contributions, if any, required by Section 2010-86 Substitute Page 1 70.705 RSMo., and to remit the deductions to the Retirement System, together with the employer contributions required by Section 70.705 and 70.750 RSMo. Section 6. Employee retirement benefits shall be based on the 'Rule of 80' retirement eligibility as defined in Section 70.646 RSMo. Section 7. Remittances and other required reports and records shall be forwarded to the Retirement System in accordance with administrative guidelines established by officials of the Retirement System. Section 8. Such election shall be effective on the first day of February, 2011. Section 9. The Board of Directors of the Jefferson City Firemen's Pension Fund is hereby authorized to transfer to LAGERS such assets as they believe, in their sole judgement, are not needed to meet the present and future needs of those retirees and beneficiaries in that plan as of the effective date of the election referenced above. The Board is further authorized to make such transfer of assets at such time as they, in their sole judgment, feel is most prudent. Section 10. All future funds generated from the Firemen's Pension Fund property tax shall be used to meet the City's obligation of contribution to LAGERS,with any excess funds being transferred to the Jefferson City Fireman's Pension Fund as created in section 6.4 of the Charter. Nothing in this ordinance shall be considered to release the City from its obligations to beneficiaries under the Jefferson City Firefighter's Pension Plan as of the effective date. Section 11. The Mayor and City Clerk are hereby authorized to execute such other documents as may be required by LAGERS to effectuate this transfer, including a hold harmless agreement. Section 12. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
