HomeMy Public PortalAbout1990-58Member %) ) / C h e 1' introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 676 -6-8 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO TWINCO AUTOMOTIVE WHEREAS, Twinco Automotive (Applicant) has applied for a conditional use permit for an office/warehouse facility containing approximately 70,000 square feet on a parcel west of Willow Drive and north of Walter G. Anderson; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the matter was reviewed by the planning commission on August 14, 1990, and by the City Council on August 21, 1990; and WHEREAS, it has been determined that the construction of the proposed office/warehouse facility will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following conditions: 1. The building shall be constructed of rockfaced block and decorative precast panels and shall be in compliance with all City performance standards; 2. All signs shall meet City ordinance requirements; 3. The rooftop mechanical equipment shall be screened with compatible materials so as not to be visible from adjacent streets or properties; 4. The Applicant shall install landscaping in accordance with City require ments; 5. There shall be no outside trash containers; 6. The parking area shall be constructed to a five (5) ton capacity and the loading area to a nine (9) ton capacity; 7. Hours of operation shall be 6:00 a.m. to midnight, seven days per week; 8. The number of employees on site shall not exceed 75 or the verified capacity of the on -site septic system; 9. All exterior lighting shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and that no light is cast directly on any other property or right-of-way; 10. Site drainage, access and construction of site elements shall be accomplished in compliance with the requirements of the city engineer as expressed in his letter of August 10, 1990, attached hereto as Exhibit A; 11. The building shall be reviewed by the fire department; 12. The Applicant must obtain approval of the plan for site drainage from the Elm Creek Watershed District and the U.S. Army Corps of Engineers; 13. There shall be no exterior storage on the site; 14. It is acknowledged that the City will not require that the building parking lot be screened with berms or landscaping but will require that screening be provided in accordance with ordinance standards when buildings are constructed on the additional parcels to be created from subdivision of the 39 acre tract owned by the Applicant; 15. The maximum number of trucks which may be parked overnight at the site is 10; 16. The Applicant shall convey to the City the drainage and utility easements required by the city engineer; 17. There shall be no outside loudspeakers on site; 18. The Applicant shall install or cause to be installed fire hydrants at the southeast and northwest corners of the proposed building; 19. The Applicant shall pave Willow Drive in phases in accordance with the development agreement; 20. The Applicant shall dedicate the right-of-way for Willow Drive and for the future east -west street to be located north of the subject building on the plat; 21. No hazardous waste shall be collected or stored inside the building; 22. The septic system shall be located on the same parcel as the building; 23. The fire lane may be gravel surfaced but shall be constructed to city specifications; 2 24. This conditional use permit is conditioned upon the Applicant seeking and obtaining approval from the City for a subdivision of the 39 acre parcel into five lots in conformance with the subdivision concept plan attached hereto; 25. The Applicant shall pay $1,000 per acre (for 10 acres) at the time of issuance of the building permit, as an assessment for extension of water to the area. The Applicant shall pay $1,000 per acre for the remaining 23 acres at the time of issuance of a permit for the next building to be constructed; 26. The Applicant shall execute a development agreement in a form acceptable to the city attorney and post security in the amount of $214,080 to ensure completion of all site work. The development agreement shall call for the City to construct the extension of Willow Drive and the east -west road and to assess the cost thereof to the Applicant; 27. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application; and 28. Any violation of the terms of this conditional use permit or any land use regulation of the City related thereto shall be grounds for revocation of this conditional use permit.
