RESOLUTION AUTHORIZING A PERSON-TO-PERSON AND PLACE- TO-
PLACE TRANSFER OF A.B.C. LICENSE NO. 1201-33-044-005 FROM:
MICHAEL KAPLAi'l TO: BURGER EXPRESS OF ROOSEVELT AVENUE, LLC
'WHEREAS, application has been made to the Mayor and Council of the
Borough of Carteret, County of Middlesex, State of New Jersey by Burger
Express of Roosevelt Avenue, LLC, for a Person~to-Person and Place to Place
transfer of ABC License #1201-33-044-005 from Michael Kaplan, present holder
of the same, and said license has consented to assign their rights to said license to
the aforesaid applicant, Burger Express of Roosevelt Avenue, LLC; and
\VHEREAS, said license shall be transferred from Michael Kaplan (inactive) to
its new location of215 Roosevelt Avenue; and
\VHEREAS, according to law, application for transfer was duly advertised in the
Home News Tribune, a newspaper circulated in the Borough of Carteret and no
objections, either verbally or in writing, were filed or made to the Governing
Body or to the Municipal Clerk regarding said transfer; and
WHEREAS, the applicant has disclosed and the local autbority has reviewed the
source of all funds used in the purchase of said license and the licensed business
and all additional financing obtained in connection with the licensed business; and
\VHEREAS, the application form is complete in all respects and the applicant is
qualified to be licensed according to aU standards established by Title 33 of the
New Jersey Statutes, promulgated thereunder, as well as pertinent local
ordinances and conditions consistent with Title 33.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED, by the
Mayor and Council of the Borough of Carteret, County of Middlesex, State of
New Jersey, that ABC LICENSE #1201-33-044-005 heretofore granted to
Michael Kaplan be and the same is hereby transferred to the applicant, Burger
Express of Roosevelt Avenue, LLC to sell alcoholic beverages in conformity with
the laws, statutes, rules and regulations of the State of New Jersey and with the
resolutions, ordinances, rules and regulations of the Borough of Carteret relating
to and concerning said license and to be held by them until said license expires,
unless sooner revoked.

BE IT FURTHER RESOLVED, that the Municipal Clerk is hereby authorized
and directed to execute the endorsement of this Person~to~Person and Place-to-
Place Transfer on behalf of the Mayor and Council of the Borough of Carteret;
and
BE IT FURTHER RESOLVED, that two (2) certified copies of this Resolution
be sent forthwith to the State of New Jersey, Department of Law & Public Safety,
Division of Alcoholic Beverage Control, Licensing Bureau, eN 087, Trenton,
New Jersey 08625-0087.
