RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JOSEPH PASTOREK WHEREAS, Joseph Pastorek (Applicant) has applied for a conditional use permit for an office/warehouse facility containing approximately 4,800 square feet at 770 Tower Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the matter was reviewed by the planning commission on August 14, 1990, and by the City Council on September 4, 1990; and WHEREAS, it has been determined that the construction of the proposed office/warehouse facility will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following conditions: 1. The building shall be constructed of concrete block as shown on the plans submitted by the Applicant and shall be in compliance with all City performance standards; 2. All signs shall meet City ordinance requirements; 3. The rooftop mechanical equipment shall be screened with compatible materials so as not to be visible from adjacent streets or properties; 4. The Applicant shall install landscaping in accordance with City requirements; 5. There shall be no outside trash containers or they shall be screened to the satisfaction of city staff; 6. The parking area shall be constructed to a nine (9) ton capacity, screened to the satisfaction of city staff and surrounded by concrete curbs and gutters; 7. Hours of operation shall be 4:00 a.m. to 9:00 p.m., seven days per week; 8. The number of employees on site shall not exceed 3 for the entire building; 9. A11 exterior lighting shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and that no light is cast directly on any other property or right-of-way; 10. Site drainage and driveway swales shall be accomplished in compliance with the requirements of the city engineer as expressed in his letter of August 10, 1990, attached hereto as Exhibit A; 11. The building shall be reviewed by the Hamel fire department; 12. There shall be no exterior storage on the site; 13. No trucks may be parked overnight outside of the building; 14. There shall be no outside loudspeakers on site; 15. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application; and 16. Any violation of the terms of this conditional use permit or any land use regulation of the City related thereto shall be grounds for revocation of this conditional use permit. NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City of Medina that variances be granted to reduce the required rear yard setback from 30 feet to 18 feet and the required side yard on the west from 30 feet to 20 feet on the grounds that the variances are consistent with neighborhood standards and that the shape of the lot is a hardship. 2 Dated: /1 , 1990.
