RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
DENNIS L. HEDTKE
WHEREAS, Dennis L. Hedtke (Applicant) has applied for a conditional use
permit for an office/warehouse/manufacturing facility expansion of approximately
22,000 square feet at 3522 Sioux Drive; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, the matter was reviewed by the planning commission on
August 28, 1990, and by the City Council on September 4, 1990; and
WHEREAS, it has been determined that the construction of the proposed
office/warehouse/manufacturing addition will not impede the orderly development
of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that a conditional use permit be granted to the Applicant for
the stated purpose, subject to the following conditions:
1. The building addition shall be constructed of materials which are compatible
with the existing building and shall be in compliance with all City
performance standards;
2. All signs shall meet City ordinance requirements and shall be approved by
staff;
3. The rooftop mechanical equipment shall be screened with compatible
materials so as not to be visible from adjacent streets or properties;
4. The Applicant shall install landscaping in accordance with City requirements
and all landscaping shall be maintained;
5. The outside trash container shall be screened from view from adjacent
properties or streets;
6. The parking area shall be constructed to a five (5) ton capacity and with 40
spaces, all in accordance with the site plan approved by the City;
7. The loading area shall be constructed to a nine (9) ton capacity in
accordance with the approved site plan. There shall be no more than two
trucks parked outside on the site overnight;
8. Hard surface coverage of the site shall be in accordance with the plans
approved by the City. A11 blacktop areas not shown on the site plan shall be
removed;
9. All tenants in the building shall be regulated through administrative
conditional use permits issued by the zoning administrator;
10. Hours of operation shall be 6:00 a.m. to midnight, seven days per week;
11. The number of employees on site shall not exceed 35;
12. All exterior lighting shall be designed and installed so that the globe is
recessed and enclosed on all sides except the bottom and that no light is
cast directly on any other property or right-of-way;
13. The building shall be reviewed by the Hamel fire department;
14. The Applicant must obtain approval of the plan for site drainage from the
Elm Creek Watershed District;
15. There shall be no exterior storage on the site;
16. The Applicant shall convey to the City the drainage and utility easements
required by the city engineer;
17. The Applicant shall dedicate the right-of-way for T.H. 55 and Sioux Drive
required by the city engineer;
18. The building in the southeast corner of the property shall be removed no
later than two years following the date of adoption of this resolution;
19. The two parcels shall be combined into one lot;
20. The manhole, castings, gate valves and hydrant shall be raised to meet the
new lot grade as recommended by the city engineer and the existing 18 foot
culvert shall be placed at the proper elevation and a baffle installed;
21. The Applicant shall meet the ponding and drainage requirements of the city
engineer. The pond may be constructed entirely on the Applicant's property
or partially on the property to the east;

22. The zoning administrator and city engineer shall review all plans submitted
by the Applicant for compliance with City ordinances and with the terms of
this conditional use permit;
23. The Applicant shall execute a development agreement in a form acceptable
to the city attorney and post security in the amount of $76,475 to ensure
completion of all site work;
24. The Applicant shall pay to the City a fee in the amount determined by the
staff to represent the actual cost to the City of reviewing this conditional
use permit application; and
25. Any violation of the terms of this conditional use permit or any land use
regulation of the City related thereto shall be grounds for revocation of this
conditional use permit.
