HomeMy Public PortalAbout12-8328 Agreement with Becker & Poliakoff PA Sponsored by: City Manager RESOLUTION NO. 12-8328 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AND EXECUTE AN AGREEMENT WITH BECKER & POLIAKOFF, PA, TO PROVIDE STATE LOBBYING SERVICES FOR A PERIOD STARTING RETROACTIVELY FROM THE END OF THE PREVIOUS AGREEMENT AND ENDING DECEMBER 31, 2012, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN A TOTAL AMOUNT OF $69,999.84, PAYABLE FROM ACCOUNT 19- 519312; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, pursuant to Resolution No. 07-7070, the contract with Becker & Poliakoff, PA (Piggybacking on West Park) was entered for a two (2) year term, with the option to renew for two (2) years; and WHEREAS, the City Commission of the City of Opa-locka desires to approve of Becker & Poliakoff providing lobbying services at the state level for a one-year period retroactive to the end of the previous contract (1/1/11 — 12/31/11) and for an additional one-year period ending December 31, 2012; and WHEREAS, the Retroactive amount to be approved is $34,999.92, of which $11,621.64 remains unpaid, and the amount for the additional one-year agreement is $34,999.92, making the total approval amount $69,999.84; and WHEREAS, the City Commission of Opa-locka authorizes payment for state lobbying services starting January 1, 2011, the date after the previous agreement expired, and continuing for 24 months, ending December 31, 2012. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Resolution No. 12-8328 Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The City Commission of the City of Opa-locka authorizes the City Manager to enter into and execute an agreement with Becker & Poliakoff, PA, (piggybacking on West Park's Agreement) to provide state lobbying services for a period starting retroactively from the end of the previous agreement, January 1, 2011, and ending on December 31, 2012, in a form acceptable to the City Attorney, in a total amount of $69,999.84, payable from Account Number 19-519312. Description: Following direction from the City Commission, staff is presenting a resolution to enter into and execute an agreement with Becker & Poliakoff, PA, a lobbying and law firm, to provide lobbying services at the state level to start retroactively from the end of the previous agreement (1/1/11-12/31/11) and continue for an additional one- year period from January 1, 2012 through December 31, 2012, for a total of 24 months of service. Currently, the state contract, through Resolution 07-7070, was for a two-year term beginning on January 1, 2007 and ending on December 31, 2008. The agreement also allowed one two-year extension beginning on January 1, 2009 and ending on December 31, 2010. Resolution 09-7946, expanded services to include lobbying at the federal level for a two-year term beginning on November 1, 2009 and ending on November 2, 2010, but the City never entered into an agreement and the City has not paid for such services. Becker& Poliakoff, P.A. 1 Approval of this resolution will allow the retroactive approval of Becker & Poliakoff, PA for the period that they have provided services and not been approved and/or paid at the state level. Approval of the resolution would authorize payments for state lobbying services starting on January 1, 2011, which is the date after the respective previous agreement expired, and ending on December 31, 2012. The current outstanding balance for 2011 is $11,621.64, which shall cover payments not made for 2011. This resolution, like previous resolutions in 09' and 07', is piggybacking on the City of West Park's agreement, which is currently active. Account Number: Account# 19-519312. Financial Impact: Approval will have a negative fiscal impact. Costs for services pertaining to the one-year extension are $34,999.92 or $2,916.66 per month. Cost for the retroactive approval from January 1, 2011 through December 31, 2011 is also $34,999.92, of which $11,621.64 remains unpaid. The City has already paid for all 2011 services except for July, September, November and December. The total cost to be approved, including the one year extension and period where services were performed outside of an approved contract, is $69,999.84, which includes 24 months of service at $2,916.66 per month. Analysis: Due to the 2012 Legislative Session starting early (January 10th) because of redistricting staff recommends a one year extension to the state lobbying contract with Becker& Poliakoff.
