HomeMy Public PortalAbout12-8329 United State Association of CDC Inc Sponsored by: City Manager RESOLUTION NO. 12-8329 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH UNITED STATES ASSOCIATION OF CDC INC. FOR COMPLETE RECONSTRUCTION OF PUMP STATION 5 IN AN AMOUNT NOT TO EXCEED FOUR HUNDRED FIFTY THOUSAND DOLLARS ($450,000.00); PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, complete rehabilitation is required for Pump Station 5, which has utilized a by-pass pump since being damaged in an accident; and WHEREAS, to obtain a certificate of occupancy and meet the opening timeline for their building, the United States Association of CDC wants to complete the reconstruction of Pump Station 5, per the terms and condition of the agreement attached hereto; and WHEREAS, entering into a public private partnership with USA of CDC, will expedite rehabilitation of Pump Station 5; and WHEREAS, the City will save the current $1500 a month rental expense of utilizing a by-pass pump; and WHEREAS, the estimated cost of the complete reconstruction of Pump Station 5 is $450,000; the City presently has a grant for $242,500 for the reconstruction. The City will pay 50% of the total cost to USA of CDC in FY 2012 from Account Number 35-535630, and the balance will be paid in FY 2013 from the Enterprise Fund; and Resolution No. 12-8329 WHEREAS, the City Commission of the City of Opa-locka desires the City Manager to enter into an agreement with United States Association of CDC, Inc., for complete reconstruction of Pump Station 5. NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby authorizes and directs the City Manager to enter into an agreement with United States Association of CDC, Inc., for complete reconstruction of Pump Station 5, in an amount not to exceed Four Hundred Fifty Thousand Dollar($450,000.00), in substantially the form attached hereto as Exhibit "A". Section 3. This resolution shall take effect immediately upon adoption. FOR COMPLETE RECONSTRUCTION OF PUMP STATION NUMBER 5 FOR AN AMOUNT NOT TO EXCEED FOUR HUNDRED FIFTY THOUSAND DOLLAR($450,000.00). Description: The City of Opa-Locka Pump Station 5 is in moratorium and a complete rehabilitation is required per Remedial Action Plan as per the terms of the Consent Agreement between the City of Opa-locka and the Department of Environmental Resources management (DERM). The Pump Station 5 is on by-pass pump since August 1, 2011 due to an accident. United States Association of CDC Inc. (USA CDC) would like to complete the reconstruction of the station per the terms and conditions of the attached agreement in order to obtain certificate of occupancy for their building which this Pump Station services. The Public Private Partnership (PPP) of the City and USA CDC will expedite the construction completion and city will get rid of the rental by- pass pump very soon. Without the PPP effort the station rehabilitation will not be completed in FY 2012 due to lack of fund. Currently the City is paying $1500 per month for the temporary pump rental which allows sewer services in this area. Financial Impact: Account #35-535630. The City has a grant for $242,500 for the reconstruction of the Pump Station. The complete reconstruction of the Pump Station is estimated to cost $450,000.00. The City will pay 50% of the total cost to USA CDC in FY 2012 and the balance of the amount will be paid in FY 2013. Implementation Timeline: Immediately with the projected completion time of. Legislative History: None 1 Recommendation(s): Staff recommends approval. Analysis: USA CDC, owns an apartment complex located very close to the Pump Station and need the Pump Station in working condition in order to operate the building. In order to reconcile this situation, USA CDC is willing to take control of the reconstruction of Pump Station 5 which will allow them to meet their timeline of opening the building for rental. The final design and construction of the facilities shall meet the requirements set forth by the City, and all applicable Local, State and Federal Standards. Proper initiative has been taken in order to provide the correct data required for the design of the Pump Station to USA CDC in order to avoid the mistakes made in the past at Pump Station 14.
