HomeMy Public PortalAbout1981-06-30 MeetingCOUNCIL MINUTES June 30, 1981 The Council of Bal Harbour Village met Tuesday, June 30, 1981 at 9:30 A.M. in the Village Hall. Present: Messrs. Beatty, Printup, Taplin and Sherman Absent: Miss Gray Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Sherman and voted the minutes of the meeting of May 26, 1981 were approved as submitted. Mayor Printup explained that the Public Hearing was now open for comments and suggestions for the use of Federal Revenue Sharing Funds in the 1981-82 Budget. Mr. Maley explained that the money on hand, and that which is anticipated during the coming fiscal year, would amount to approximately $25,300.00. There were no suggestions from those present in the audience regarding the use of the money. Mr. Maley said that in the past, Federal Revenue Sharing money had been used to defray the cost of the operation of the library operated by Surfside for Bal Harbour and Bay Harbor Islands. It was moved by Mr. Beatty, seconded by Mr. Taplin and voted that $25,000 be allocated to the expenditure for the library. Mr. Simm and Mr. McNaughton of the Dade County Dept. of Traffic & Transportation discussed the problem of tour bus parking along Collins Avenue. Mr. Simm said that after their last meeting with the council they had identified the problem in three areas: regular Metro busses; tour busses varyingin number and schedule; and special busses for hotel activities. Three solutions were suggested to the council: 1. Channeling the northbound flow into two lanes by stripping and reserving the right lane for bus parking and working vehicles, 2. Cutting into the sidewalk area to make a bus bay, and 3. Limited Bus parking on the Sheraton property. After discussion with rep- resentatives from the Sheraton and the council it was decided that all three suggestions could be utilized to some extent. Mr. Simm said he would take the matter up with the State Road Department. It was moved by Mr. Beatty, seconded by Mr. Taplin and voted that the matter be discussed again at the next meeting. The council discussed with Mr. Gold the situation of noise which occasionally originates from the hotels and high rises on Collins Avenue due to outside activities on their pool decks and terraces. Mr. Gold said Mr. Sherman had asked him to see if the Dade County code governing levels of noise applies to Bal Harbour as our ordinances do not cover this. Mr. Gold said he would get an opinion regarding the County ordinance and after that the council could decide whether they wish to address the problem by using sound consultants and the purchase of equipment which would be needed if Bal Harbour decided to be more specific on types and levels of noise. June 30, 1981 Mr. Karl Hart explained the basis of the Great Lakes Dredge and Dock Company suit and the Court's action to date. He said the delays in the trial were caused by the Federal Court's de- laying all civil cases in order to try criminal cases. Each postponment means reviewing, resummoning witnesses and the like. The amount of time spent on the case also includes the time needed for both himself and Miss Vicevich to develope know- ledge and expertise in each area so that they can cross ex- amine the witnesses. He said he is also concerned about the cost of the suit, but that the other government agencies in- volved with Bal Harbour had been dismissed by the court and Great Lakes has refused to drop the case before it went to trial. Mr. Hart gave Mr. Maley a breakdown of time and expenses on the case. Mr. Gold said that he would like to congratulate Mr. Hart on the handling of the case. Mr. Cold read in full for final reading ORDINANCE NO. 230 granting UltraCom of Dade County, Inc. a fifteen year non-ex- clusive cable television franchise. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted that the ordinance be adopted. Mr. Maley presented an agreement with Security Trust Com- pany for financial management service for the Bal Harbour Village Employees Pension Trust. He said that Mr. Gold was reviewing the pension ordinance to see if we also need a separate agree- ment naming the Security Trust Company as Trustee. On motion of Mr. Sherman, seconded by Mr. Taplin and voted the contract was approved. Mr. Gold left the meeting at this point and was not present for the following items. Mr. Maley reported that Dade County has completed the water line to serve Bal Harbour and Bay Harbor Islands that our con- tractor had started work on our hook up. He said that Bay Harbor Islands had asked the county to reimburse Bay Harbor Islands and Bal Harbour Village for the section of the line under 96th Street and add it to the capital cost of the project. He explained that Dade County would like title to the old 12" line running from Miami Beach through Surfside that was originally put in by the developers of Bal Harbour and Bay Harbor Islands. There will be a meeting tomorrow at Bay Harbor Islands Town Hall to discuss this, and as many of our council as possible should attend. The Village Manager said he had bids for a .06 gauge hot dipped galvanized fence at the parking lot under Bakers Haulover bridge, ad discussed at last month's meeting, in the amount of $3,885.00. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted that the security fence be installed. The council discussed the application for comfort stations on the beach. It was the council's decision not to go ahead with the project. It was moved by Mr. Beatty, seconded by Mr. Sherman and voted to withdraw our application for the comfort station from Florida Division of Land Management. June 30, 1981 On motion of Mr. Taplin, seconded by Mr. Beatty, the meeting was adjourned at 12.30 P.M. Beatty, Printup and Sherman Absent: Mr. Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Clifford Schulman, representing the Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of June 30, 1981 were approved as submitted. Mr. Howard Brandston presented his design for the lighting improvements on Collins Avenue. He related the history of roadway lighting and explained the placement of lights for special effects and types of lights to be used for this climate. Mr. Brandston and Mr. Martinez, our electrical engineer, ex- plained to the council and those present the significant changes that would take place along the side walks and in the median strip when the work is com- pleted. No action was taken on the matter. Mr. Kevin McNaughton of the Dade County Department of Traffic and Trans- portation explained the traffic flow, both north and south on Collins Avenue. He said that his department met again with representatives of the Sheraton Bal Harbour. In addition to the solution discussed last month of designating the right lane for turns and temporary bus loading, the hotel was willing to utilize five spaces in the north parking area to permit two waiting busses. The north area could be utilized after a new exit driveway is opened to Collins Avenue. Also there would be room south of the hotel driveway to hold 6 more busses during certain periods. Mr. Frank DeLuca, Traffic Engineer for the Florida Department of Transportation explained that they had not completed their review of the solutions proposed by Dade County. Mr. McNaughton was asked to also study the left turns of northboud traffic on to 96th Street. Mr. DeLuca said he would have a report on their study for the next meeting. Mr. Sherman said that after the discussion of occassional noice problems from the hotels and apartments on Collins Avenue, a proposed noise ordinance has been prepared.
