1. CALL TO ORDER:
CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
DECEMBER 16, 1980
Mayor Atkins called the regular meeting of the City Council to
order at 7:36 p.m. on Tuesday, December 16, 1980, in the Council
Chamber of the City Hall.
2. INVOCATION:
The invocation was given. by Dr. Marshall Ketchum, First United
Methodist Church, 5957 N. Golden West Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Atkins.

Councilman Tyrell moved to excuse Councilman Dennis for cause,
seconded by Councilman Gillanders and carried.
CONSENT CALENDAR:
Councilman Gillanders requested the minutes be corrected to reflect
under Items 12(C) that the SCAG proposal for an airport will not. be
discontinued.
On motion by Councilman Tyrell,: seconded by Councilman Gillanders
Items A through I on the Consent Calendar were approved as recommended.
A. APPROVAL OF MINUTES - Regular Meeting of December 2, 1980
Approved as corrected.
B. RECOMMENDATION. FROM. TRAFFIC COMMISSION - Meeting of December 3,
1980, OAK AVENUE, SOUTH OF CAMINO REAL - MODIFICATION OF CURB
MARKINGS ADJACENT TO INTERMEDIATE SCHOOL
Approved elimination.of 60 feet of passenger loading zone on the
west side of Oak Avenue and adding 70 feet of red curb, repainting
curb markings in front of Oak Avenue School, and providing selective
enforcement during the afternoon period when bicycle traffic is
leaving 7chool,
C. PLANNING COMMISSION ACTION: Meeting of December 9, 1980
Received and filed memo relating to. action taken by the Planning
Commission at their regular meeting held December 9, 1980.
D. ACCEPTANCE OF WORK: RESURFACING OF THREE TENNIS COURTS AT
LIVE OAK PARK
Accepted, the work completed and authorized payment in the amount
of $7,155000 and authorized filing. Notice of Completion and release
of the 10% retention at the end of the 35 -day lien period.

E. APPROVAL OF WATER SYSTEM: TRACT NO. 36377
Found the work completed-and released the Water System Agreement
between the:developer.and the City, and released the Faithful
Performance Bond.

Denied claim and-referred to JPIA,
G. RESOLUTION NO, 80 -1952: APPROVING REVENUE DISTRIBUTION PLAN

6. COMMUNICATIONS:
A. Request for Time Extension re: Tentative Tract No. 37528 -
5602 Welland Avenue

City Manager Koski presented a letter from Loren Phillips & Associates
requesting an extension of time for the recording of Final Tract Map.
Council expressed concern that no justification for the request was
given .. and for this reason, the request was continued to the
January 6, 1981 Council meeting:,
B. Approval of Final Map - Tract No. 37830, 6004 -6018 Rosemead Blvd.
City Manager. Koski. presented a recommendation for approval on final
map for Tract No. 37830 from the County Engineer.
Councilman Tyrell moved to approve the map, accept the work agree
ment and. faithful performance bond; found that the. project will not
violate any of the.provisions of the Subdivision Map Act and instructed
the City Clerk to endorse on the face of the map Council approval,
seconded by Councilman Gillanders and carried.

RECESS TO CRA
City Council recessed at 7:47 p.me to meet as the Community Redevelopment
Agency, Mr. Dennis being absent; approved the minutes of the regular
meeting held December 2, 1980, and concurred with Planning Commission
resolution approving a Brake Repair Shop at 5530 Rosemead Boulevard. The
minutes are set forth in full in the records of the Agency.

RECONVENE AS CITY COUNCIL:

There was no action to be taken.
9. MATTERS FROM CITY OFFICIALS:
A. Parking Citations - Payment & Collection of Bail Schedule
City Manager Koski presented staff recommendation for contracting
data processing of parking citations, and the collection of bail
by the Alhambra Municipal Court, including an implementation
calendar.
In answer to Council's question relative to the increased percentage
charged by the court, and the necessity of contracting with a data
processing. firm, City Manager Koski advised AB 2392 gives the court
discretion as to whether or not it will handle parking citations and
the Alhambra Municipal Court had advised it will discontinue that
service; however, they will continue on a contract basis and, have
increased their charges to cover costs. The data processing firm,
will pick up those not paid and delinquent and submit the information
to. the Department of Motor Vehicles. Staff feels the handling of
collections at City Hall is impractical because it would require
additional personnel and equipment, as well as crowding the facilities.
Councilman Tyrell moved to approve the implementation calendar for
the collection of parking citations, approve an increase of. the Court's
percentage of collections from 11% to 20 %, authorize staff to pursue
an increase in the bail schedule from $6 to $11, and authorize staff
to engage the services of Optimal Data Systems in accordance With
their proposal dated December 10, 1980, for a one -year period,
seconded by Councilman Gillanders and carried.
B. Underground Utility District No. 4
Request Authorization to Advertise and Receive Bids
City Manager Koski presented a calendar of events for the preparation
of specifications for bids for the work to connect the utilities to
the property owners structures within Underground Utility District
No. 4.
Councilman Merritt moved to approve the calendar of events and
authorize the advertising and receiving of bids, seconded by Council -
man Gillanders and carried.
C. City Manager Koski directed Council's attention to the two
alterna.tive.ordinance amendments relating to repair of vehicles
on residential properties which were distributed to City Council.
The public hearing has been set for January 6, and staff is re-
questing direction as to how Council wishes to proceed.
It was the consensus of the City Council to hold the public hearing
on both alternatives.
D. City Manager Koski advised the City received a request from
G. L. Kaplan Construction Company for payment of $2,500 for
architect and engineering services. These services were to be
included in the construction proposal relating to the contract for
the Emergency Operating Center.
Councilman Tyrell moved to deny request dated November 19, 1980,
seconded by Councilman Merritt and carried.
E. City Manager Koski presented a recommendation from Captain
Butler for an additional 40 hour one -man general law car during
daytime hours.
Councilman Merritt moved to approve, appropriate an additional
$76,365 and amend the adopted budget accordingly, seconded by
Councilman Gillanders and carried.

F, Councilman Merritt requested staff make a, field check of those
commercial properties operating under a Conditional Use Permit; one
condition of which is the requirement to have landscaping and
contact those operators who are not maintaining the areas,
G, Councilman Tyrell commented on our society today which will
make a national hero of a person who was the subject recently of
deportation proceedings and who was tragically slain, while at-the
same time good solid citizens are being, killed, as in the, Nuns in
El Salvador and customers at a downtown restaurant and hardly any
notice. taken..
H. Councilman Gillanders advised he would be attending a hearing
Thursday regarding the airport proposed by SCAGO He also commented
on material he had received regarding a proposed appointed bureaucracy
to handle inspection of motor vehicles, The proposal includes :a
Director whose position will be autonomous; there .will be no criteria
to determine whether the vehicle will pass; a fee ,accompanies; the
inspection and also every .re- t,est,.This matter 'will be.presented
to the Transportation, and _Utilities Committee on Thursday for, their
approval. .
Council concurred that the program should be opposed and letters
sent to our legislative representatives°
l..a Mayor Atkins commented .on the, tragedy which occurred recently
in the arson of Temple Beth David. He advised he had attended a
meeting with members of the Ministerial Association and the Chamber
of Commerce..in. ,support; of ,the Temple; and he was also happy to.
announce that-suspects had been apprehended.
Jo Council received and filed a memo relating to the termination
proceedings of Annexation Area 80 -2.a
Council recessed to an Executive Session at 8:30 p.m. to discuss possible
litigation. Council reconvened at 8 :45 p.m.
K. Civil Rights indemnity
City-Attorney Martin advised he presented a_memo relating to Civil
Rights Indemnity dated December 10, 1980,
Councilman :Tyrell moved to approve the City Attorney's memo dated
December l0, 1980, seconded-by- Councilman Gillanders and carried,
10. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Merritt,
meeting adjourned at 850 p.m. Next regular meeting of the City
Council will be held Tuesday, January 6, 1981, 7:30 pom. in the
Council Chamber of the City Hall.
