RESOLUTION GRANTING PRELIMINARY
APPROVAL OF A SUBDIVISION TO BE
KNOWN AS SOUTH RIDGE FARM
FOR MICHAEL LEUER
WHEREAS, Michael Leuer (Applicant) has requested approval of a plan to
subdivide a tract of land containing 36 + acres into five lots according to the
preliminary plat attached hereto as Exhibit A; and
WHEREAS, the planning commission and city council have reviewed the
preliminary plat submitted by the Applicant for compliance with City
requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that preliminary approval is granted to the Applicant for the
subdivision to be known as South Ridge Farm, subject to the following conditions:
1. The final plat shall show an Outlot B between Lots 4 and 5 to be used as a
roadway if the property to the west develops;
2. The driveway for Lot 5, must be moved to access Outlot A at the time any
building permit is issued for the lot;
3. The pond at street station 7+00 must be replaced on either Lot 2 or Lot 5;
4. The Applicant must obtain approval for the subdivision from the Minnehaha
Watershed District and the Minnesota DNR;
5. Access from Outlot A to Co. Rd. 24 must be obtained from Hennepin
county;
6. City staff must review the effect the subdivision is likely to have on the
water flow across Co. Rd. 24;
7. The Applicant must show on the final plat all right-of-way and drainage,
ponding and utility easements required by the city engineer;
8. The Applicant shall pay park dedication fees for Lots 1-4 in the amount
determined by city staff;
9. Outlot A must be paved pursuant to a development agreement to be signed
by the Applicant in a form satisfactory to the city attorney;
10. The Applicant must pay to the city for administrative expenses the amount
determined by the city staff to represent the actual cost to the city of
reviewing the subdivision;
11. The Applicant must submit a current abstract of title or registered property
abstract covering all land within the subdivision for review by the city
attorney; and
12. The Applicant must submit the final plat to the city for approval within 180
days of the date of the adoption of this resolution, which final plat shall in
all material respects conform to the preliminary plat, except that it shall
incorporate all changes and modifications required by this resolution.
