HomeMy Public PortalAboutExhibit MSD 73C - OMCI Grant GuidanceSeptember 21, 2022 stormwater RE: Request for Intent to Participate in Municipal Reimbursement Program from Operations, Maintenance, and Construction Improvement (OMCI) Taxing Subdistricts Dear Public Officials: In 2023, the Metropolitan St. Louis Sewer District (MSD) is again offering a grant program in certain OMCI subdistricts for local agencies to use up to a 50% share of OMCI subdistrict revenue from their municipality for their own stormwater purposes. Included with this letter is a Municipal Certification of Intent to Participate form for each OMCI subdistrict in which your municipality is located. As in years past, this form identifies the OMCI subdistrict and the 2023 revenue allocation for which the municipality is eligible. It also indicates the municipality’s unallocated balance from previous years (if applicable), and the total allocation available. At this time, you only need to identify your municipality’s interest in participating in the grant reimbursement program for 2023. There is not yet a need to identify the specific uses for the funding. Please review and return the form by October 21, 2022. Failure to respond by November 4, 2022, will forfeit the municipality’s allocation of 2023 funding. If the municipality intends to apply for a reimbursement project in 2023, please indicate that on the included form. Further guidance on the grant application process will be provided in a subsequent transmittal before the end of this calendar year. Multiple applications can be submitted to utilize the allocation; however, the stormwater use must be within the OMCI boundary from which the reimbursement is requested. Additionally, the annual fund allocations must be utilized by the municipality within five years or the unutilized portion, more than five years old, will be forfeited from the remaining balance. MSD will use the balance of the OMCI funds, not allocated for grants, for the design and construction of MSD identified stormwater capital projects within the OMCI. Eligible stormwater expenditures may include the following: storm sewer and inlet construction; drainage improvements; streambank stabilization and erosion control projects; clearing under bridges or clearing detention basins; stormwater planning or engineering costs; and other stormwater related expenses as determined appropriate by the District. Activities for MS4 permit compliance and routine maintenance are not considered eligible. Your municipality’s allocation is indicated above, and options are listed below. Last year the Village of Hanley Hills chose option (B) from the selections below. Please indicate your choice for 2023, and sign and return this form no later than October 21, 2022. You are receiving this information because you are the City’s designated contact for the program identified on the Intent to Participate form submitted to MSD in the fall of 2022. Application Applications for funding reimbursement on City administered stormwater projects can be submitted to MSD at your convenience. The grant reimbursement program is non-competitive. The funds available to the City are 50 percent of the OMCI tax revenue generated within the portion of the OMCI subdistrict within the City. A separate application is required for each project for which reimbursement is requested, but multiple projects can be submitted. Projects should be within the OMCI subdistrict boundary and meet the general project qualifications discussed below. Available Funds For an updated balance of allocated OMCI fund(s), not already encumbered for other project(s) received from the City, please refer to the Intent to Participate form sent in September 2022 or reach out to your MSD OMCI representative. The current years allocation of OMCI tax revenue will be added to any remaining fund balance from previous years. The annual fund allocation must be utilized by the City within five years, or the unutilized portion will be forfeited from the remaining balance. Important Dates There are several important dates for the 2023 OMCI Stormwater Project Reimbursement Program that you should be aware of. These dates are as follows: • March 3, 2023 – Application submittal deadline for 1st OMCI Project Review meeting • May 5, 2023 – Application submittal deadline for 2nd OMCI Project Review meeting • August 4, 2023 – Application submittal deadline for 3rd OMCI Project Review meeting • November 3, 2023 – Application submittal deadline for 4th OMCI Project Review meeting OMCI Boundary Stormwater projects utilizing OMCI funds must be within the OMCI subdistrict from which the tax revenue was collected. Eligible Project Types Stormwater project types eligible for the OMCI Stormwater Project Reimbursement Program include the following: storm sewer and inlet construction; drainage improvements; streambank stabilization and erosion control projects; floodplain buyouts or floodproofing; clearing under bridges or cleaning detention basins; stormwater planning or engineering costs; and other stormwater related expenses as determined appropriate by the District to address drainage, flooding, and erosion issues. Activities for MS4 permit compliance and routine maintenance are not considered eligible. Reimbursement Program Process Steps To aid you through the OMCI Stormwater Project Reimbursement Program process, the typical steps are outlined below for your reference: 1. MSD provides application and program guidance to municipal contact. 2. Municipality submits application and supporting material to MSD. 3. MSD conducts quarterly application review meetings. See submittal due dates above. 4. MSD informs municipal contact of the approval/rejection of the project within one month of the application due date. If approved, MSD provides a draft program agreement, prevailing wage affidavit, and additional details on requirements for the project going forward. • MSD Development Review plan approval is required if public or private sewerage and drainage works are proposed to be constructed, altered, or reconstructed. This includes altering any storm drainage channel, site drainage, or floodplain. • MSD Board approval is required if the reimbursement amount requested exceeds $50,000 or the project scope includes expanding the system with new facilities to be dedicated to MSD. 5. If Development Review Required: Municipality proceeds with design and submits plans to MSD Development Review for approval. 6. If MSD Board Approval Required: An ordinance is introduced to MSD Board allowing MSD to enter into an agreement with the municipality. One month later, MSD Board adopts the ordinance. 7. If Development Review Required: MSD Development Review approves plans. 8. MSD sends final version of the OMCI Stormwater Reimbursement Program Agreement to municipal contact. Municipality and MSD sign the program agreement. 9. If Development Review Required: Municipality pulls required permits. 10. Municipality constructs project. 11. If Development Review Required: Municipality requests final MSD inspection. MSD inspects project and if no discrepancies gives pending construction approval. 12. If Development Review Required: Municipality submits as-built drawings and if no discrepancies MSD Construction Approval is issued. 13. Municipality submits Affidavit for Payment of Prevailing Wages and invoice to MSD with supporting documentation showing costs incurred. 14. MSD reimburses municipality for incurred eligible stormwater expenditures.
