HomeMy Public PortalAbout16124 Woodson Sanitary Relief (Flora Ave to Lackland Rd) (12300)ORDINANCE NO. 16124 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Woodson Sanitary Relief (Flora Ave to Lackland Rd) (12300) in City of Overland, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessaiy court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporaiy construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Overland, Missouri within the University City Branch Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Woodson Sanitary Relief (Flora Ave to Lackland Rd) (12300) hereinafter set forth, said easements being more particularly described below: PARCEL #6 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Lot 12 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: BEGINNING at the Northeast corner of Lot 12 of Gemmer Park; THENCE along the East line of the aforementioned Lot 12 South 07 degrees, 13 minutes, 13 seconds West a distance of 62.65 feet to a point being the Southeast corner of the aforementioned Lot 12; THENCE North 82 degrees, 37 minutes, 47 seconds West a distance of 11.34 feet to a point in the South line of the aforementioned Lot 12; THENCE North 03 degrees, 54 minutes 22 seconds East a distance of 36.34 feet to a point; THENCE North 10 degrees, 04 minutes, 07 seconds East a distance of 26.41 feet to a point in the North line of the aforementioned Lot 12; THENCE along the North line of the aforementioned Lot 12 South 82 degrees, 37 minutes, 47 seconds East a distance of 12.13 feet to the POINT OF BEGINNING of the herein described VARIBALE WIDTH TEMPORARY CONSTRUCTION EASEMENT. TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. PARCEL #10 A 15.00 FOOT WIDE SEWER EASEMENT across a tract of land being Lot 8 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: The 15.00 FOOT WIDE SEWER EASEMENT is the East 15 feet of the Lot 8 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office. Excepting therefrom those portions covered by the existing easements recorded in Plat Book 51, Page 17 of said Recorder’s Office. Also, a 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described 15.00 FOOT WIDE SEWER EASEMENT; said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Lot 8 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office, St. Louis County, Missouri; said easement being parallel to and adjoining the West line of the above described 15 FOOT WIDE SEWER EASEMENT and being bounded by the North and South lines of Lot 8 of Gemmer Park. TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. PARCEL #13 A 15.00 FOOT WIDE SEWER EASEMENT across a tract of land being Lot 5 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: COMMENCING at the Southeast corner of the aforementioned Lot 5; THENCE North 82 degrees, 37 minutes, 47 seconds West a distance of 7.50 feet to the TRUE POINT OF BEGINNING of the centerline of the herein described 15.00 FOOT WIDE SEWER EASEMENT; THENCE North 07 degrees, 13 minutes, 13 seconds East a distance of 13.18 feet to a point; THENCE North 66 degrees, 38 minutes, 51 seconds East a distance of 8.71 feet to the POINT OF TERMINUS in the east line of the aforementioned Lot 5. Excepting therefrom those portions covered by the existing easements recorded in Plat Book 51, Page 17 of said Recorder’s Office. Also, a 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described 15.00 FOOT WIDE SEWER EASEMENT; said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT across a tract of land being Lot 5 of Gemmer Park as recorded in Plat Book 51, Page 17 of the St. Louis County Recorder’s Office, St. Louis County, Missouri; said easement being parallel to and adjoining the West and Northwest lines of the above described 15 FOOT WIDE SEWER EASEMENT, and being bounded by the South and East lines of the Lot 5 of Gemmer Park. TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above-described sewer construction. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out.
