AN ORDINANCE, making an appropriation of Thirteen Million Dollars
($13,000,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer construction
in Black Creek - Haddington Court Relief Sewers (11847) in the Cities of Clayton, Ladue, and
University City, Missouri; and authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 22256 with Bates
Utility Company, Inc. for sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Seventeen Million Five
Hundred Seventy-One Thousand Eight Hundred Seventy-Eight Dollars ($17,571,878.00) and the
allowance for construction change orders and other project expenses is One Million Four Hundred
Twenty-Eight Thousand One Hundred Twenty-Two Dollars ($1,428,122.00);
WHEREAS, a supplemental appropriation request is planned for Fiscal Year 2024
(FY24) for a total appropriation amount of Nineteen Million Dollars ($19,000,000.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Thirteen Million Dollars ($13,000,000.00) is hereby
appropriated from the Sanitary Replacement Fund for sanitary sewer construction in Black Creek
- Haddington Court Relief Sewers (11847) in the Cities of Clayton, Ladue, and University City,
Missouri; said contract being comprised of such terms and conditions as have been approved by
the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 22256
with Bates Utility Company, Inc. as the lowest responsible bidder for sanitaiy sewer construction
in Black Creek - ■ Haddington Court Relief Sewers (11847) in the Cities of Clayton, Ladue, and
University City, Missouri, pursuant to bids received on the 6th day of April, 2023.
The foregoing Ordinance was adopted June 8, 2023 by the following vote:
Ayes - A. Fehr, R. Wilson, G. Nicozisin, M. Evans, and B. Wahby
Nays - none
