HomeMy Public PortalAbout1981-08-25 MeetingCOUNCIL MINUTES August 25, 1981 The Council of Bal Harbour Village met Tuesday, August 25, 1981 at 9:30 A.M. in the Village Hall. Present: Messrs. Printup, Sherman, Taplin and Miss Gray Absent: Mr. Beatty Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. gold, Village Attorney. On motion by Miss Gray, seccnded by Mr. Sherman and voted, the minutes of July 28, 1981 were approved as submitted. A Public Hearing was held on the application for a variance by the Sheraton Bal Harbour to replace an existing cabana slructure with a new beach pavilion which would project 512' into the rear set back area. Representatives from the Sheraton and Mr. Maley explained the proposed new construction. As there were no objections from those present, on motion of Mr. Taplin, seconded by Miss Gray and voted, the variance was granted. Mr. Maley reported that at last month's meeting, the Dade County Depart- ment of Transportation made recommendations for striping Collins Avenue, plus parking of busses on the Sheraton property, which would necessitate a new entrance. He said Mr. Sims had checked with the State Road Department, and they were not ready to give their crnments. Mr. Gold and Mr. Maley discussed the proposed noise ordinance as re- vised by Mr. Schulman. Mr. Gold said it was very important to have a sound expert's opinion so that the ordinance could be discussed intelligently. It was moved by Mr. Taplin, seconded by Miss Gray and voted that Mr. Maley should hire a sound expert to discuss the provisions of the ordinance. Mr. Maley reported that Howard Brandston was proceeding with final plans for the Collins Avenue and 96th Street lighting. He said that he was going to New York in September to inspect installations similar to our plans, and would chekc on the candle power and type of fixtures. The council discussed with those present the Rocky Pomerance report with regard to having additional officers, so that a foot patrol could be established for sixteen hours along Collins Avenue. It was the ccuicil's opinion that this might be a crime deterrent and Mr. Maley was asked to pro- vide the council with the cost of two additional officers to the three pro- posed in the new budget. The item is to be discussed again at the first buget hearing. Financial statements for the period ending June 30, 1981, were presented. Mr. Maley explained that all departments were in order except the Sewer Fund. He requested that $30,000 be transferred from the Water Department to the Sewer Department. On motion of Mr. Taplin, seconded by Miss Gray and voted, the funds were ordered to be transferred. After review of the financial statements, on motion of Miss Gray, seconded by Mr. Taplin, the statements were filed for audit. August 25, 1981 The Village Manager reported that he had checked with the Towns of Surfside and Bay Harbor Islands on the cost of operation of their mini - busses. He said that Bay Harbor Islands' net tax supported cost is $20,000 and Surfside $10,000. After discussion, it was the opinion of the council and the majority of those present that the Village did not need a mini -bus. Mr. Maley said that Dade County has completed the water line that will serve Bal Harbour and Bay Harbor Islands, and wants title to the old water line installed by the towns in 1946. They will also reimburse Bay Harbor and Bal Harbour for the cost of the portion of the 24" line along 96th Street. It was moved by Mr. Taplin, seconded by Miss Gray and voted to transfer the water lines to Dade County Water and Sewer Authority. Mr. Maley explained that the Federal, State and County governments shared in the cost of the beach restoration program, but would not share in the legal coats to fight the Great Lakes Dredge and Dock Company suit. He said the attorneys feel that our case is justified and should be settled in October. Mr. Printup reported that we have received the prior taxes on the Balmoral, plus interest. Mr. Sherman said that he had spoken to the Village's auditors, Arthur Andersen and Co., and they agreed with him that a quarterly review of the books was a great ideal. Mr. Maley explained that the council receives quarterly statements, and the Village is in excellent financial condition. Mr. Sherman said he also wanted the Village to hire an auditor to review the proposed budget before it is voted on. It was suggested that Mr. Maley contact our account executive at Arthur Andersen to ascertain their opinion on additional quarterly reviews and possible review of the proposed budgets. Mr. Hammer said that the Village should be redistricted due to the fact the majority of voters reside on the east side of Collins Avenue. He said he believes the five districts should run from east to west. He asked if the Village Attorney could have an opinion at the next meeting whether his idea would be legal and if the present districts are legal. Mr. Gold said he would be glad to research the matter for the council. Mr. Printup said he had been approached by Mayor Clark of Dade County to see if the Village would contribute to a reception for the Municipal Judges' meeting at the Sheraton. It was moved by Mr. Sherman, seconded by Miss Gray and voted that the Village contribute $1200.00 from the Tourism Fund. Mr. Maley said that solicitations were being made for the Mildred and Claude Pepper Library Endowment Fund. It was moved by Mr. Taplin, seconded by Mr. Sherman and voted to contribute $200 to the Fund. The council discussed a recent drowning with those present. On motion of Mr. Taplin, seconded by Miss Gray, it was voted to place signs near the jetty warning of possible undercurrents. August 25, 1981 On motion of Mr. Sherman, seconded by Mr. Taplin, the meeting was adjourned at 11:50 A.M. Attest: itrk illage Clerk 1 Mayor August 25, 1981 PUBLIC HEARING September 1, 1981 The council of Bal Harbour Village met Tuesday, September 1, 1981 at 5:00 P.M. for the purpose of discussing the 1981-82 proposed budgets. Present: Miss Gray and Messrs. Beatty, Printup and Sherman Absent: Mr. Taplin Also present were Fred W. Maley, Village Manager, and Mary T. Wetterer, Village Clerk. Mr. Maley discussed the possibility of adding police officers in the budget, which would provide perbonnel for the Collins Avenue foot patrol. He told those present that the cost of each officer amounts to approx- imately $22,000. After comments from Chief Staubesand it was moved by Mr. Sherman, seconded by Miss Gray and voted that three additional officers be added to the proposed budget. Mr. Maley reported that the proposed budgets have been available since July and with the approved change in the police department the tax millage would be 3.70 mills, which equates to a 13.4% increase in taxes, due to the increased assessments. The Village Manager read from his budget letter and asked if there were any questions. Mr. John Cherin of Arthur Andersen and Co. said he had been asked by Mr. Sherman to review the proposed budgets, but that he did not know what kind of a review was desired and the scope of work will determine the cost. He told those present that he had read the budgets and talked to Mr. Maley and Miss Wetterer, and a full depth study could cost as much as $6,000. It was decided that a committee from those present could be appointed to review the budgets with the village manager before the next meeting instead of a review by Arthur Andersen and Co. It was moved by Mr. Beatty, seconded by Mr. Sherman and voted that Messrs. Rubin Prussin, Joe Brown and Max Feldman be appointed to meet with the Village Manager at 2:00 Friday, September 4th to go over the budgets. Mr. Stanley Whitman, Chairman of the Resort Tax Advisory Committee explained the use of the Resort Tax funds in the past and some proposed expenditures in the 1981-82 Tourism budget. September 1, 1981
