PROFESSIONAL SERVICES CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to perform
engineering design, bid preparation and solicitation for improvements to
Carteret Park Basketball and Tennis Corals; and
WHEREAS, pursuant to N.J.S.A. 40A:ll-5(l)(a) professional services are
exempt from the requirements of compctitive bidding, and
WHEREAS, the local finance officer has certified that funds are available.
NOW, THEREFORE BE IT RESOLVED, that Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Killam Associates
at a maximum cost of not to exceed $4,500.00
BE IF FURTHER RESOLVED, that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED, that the contract is awarded without
competitive bids in accordance with N.J.S.A. 40A:ll-5(1)(a) due to the
specialized and professional nature of the services provided.

As per Resolution Number 00-160.
THE CONTRACTOR does hereby agree to perlbrm the following
PROFESSIONAL SERVICE TO PERFORM ENGINEERING DESIGN, BID
PREPARATION & SOLICATION FOR IMPROVEMENTS TO CARTERET PARK
BASKETBALL & TENNIS COURTS.
NOT TO EXCEED $4,500.00.
According to the terms set forth in Resolution
THE INDEMNIFICATION AGREEMENT
ON THE REVERSE OF THE PURCHASE
ORDER SHALL BE LIMITED TO THE
VENDOR'S NEGLIGENT OR WRONGFUL
ACTS.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
IN WITNESS WHEREOF, the parties hereto have hereunder set their hands and seals or
caused these presents to be signed by their proper corporate officers and their corporate
seals to be hereto afl]xed, the day and year written above.
