HomeMy Public PortalAbout12-8350 Waiver of Code Enforcement Liens on 13290-13340 Port Said Road Sponsored by: City Manager Resolution No. 12-8350 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO AUTHORIZE THE WAIVER OF $5,620.41 IN CODE ENFORCEMENT LIENS ON THE PROPERTY LOCATED AT 13280-13340 PORT SAID ROAD, ALTERNATE PROGRAM, INC; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City has received a request from Alternate Program, Inc., to waive citations on 13280-13340 Port Said Road; and WHEREAS, there are two (2) types of lien outstanding on the property, a water/sewer lien in the amount of$3,645.31, and a code enforcement lien in the amount of$13,975.41; and WHEREAS, the water lien cannot be waived and has been paid in full, however, the Commission has an option to waive a portion of the code enforcement lien; and WHEREAS, the applicant has agreed to pay $8,355.27, a portion of the lien, and is requesting a waiver of$5,620.41; and WHEREAS, the City Commission, hereby agrees to waive a portion of the outstanding Code Enforcement liens and citations for Alternative Program, Inc., located at 13280-13340 Port Said Road. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka, hereby authorizes the waiver of a portion of the outstanding Code Enforcement liens and citations for Alternative Program, Inc., located at 13280-13340 Port Said Road, in the amount of$5,620.41. Resolution No. 12-8350 Section 3. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 14th day of March, 2012. ''%���, , anager DATE: Ma ' 6/'i 12 RE: 'ode Enforcement Lien Wavier Request: Approval of Resolution authorizing the City Manager to waive $5,620.41 in Code Enforcement Liens to the Alternative Program, Inc. Description: The City's management has been approached to consider waiving certain Code Enforcement liens and citations on 13280-13340 Port Said Road. Staff researched the request and noted that there are 2 types of liens outstanding on the property a Water/Sewer liens of$3,645.31 and a Code Enforcement lien of$13,975.41. Statutorily the water/sewer liens of$3,645.31 cannot be waived and has been paid in full. The Commission has a option to waive a portion of the Code Enforcement fines and citations of$13,975.41 at their discretion. With this in mind, the applicant has agreed to pay a portion of the fee$8,355.27 and is requesting the waiver of$5,620.41. Recommendation(s): Staff recommends approval. Our approval is based on the following: 1) The applicant will pay$8,355.27. 2) Upon completion the project will generate $151,000 in taxes over a five (5) year period. 3) This project represents a $15,000,000 investment in Opa-locka by combined efforts of the State of Florida and Miami-Dade County. 4) One Hundred Fifty (150) construction jobs will be created and forty (40)permanent jobs will be created. Account Number: Not Applicable Financial Impact: This action will reduce the accounts receivables balance but will enhance the tax base of the City.
