HomeMy Public PortalAbout1990-88Member adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. %')/ Jig RESOLUTION GRANTING A VARIANCE TO RICHARD WOOD WHEREAS, Richard Wood (Applicant) has requested variances for the property at 335 Lakeview Road for the construction of a new septic system; and WHEREAS, Section 721.03 of the City's Code of Ordinances requires that variances from the strict interpretation of the City's Individual Sewage Treatment and Disposal Systems Code be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and has concurred with the Planning Commission's recommendation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant be granted the following variances: 1. Reduce drainfield distance from the ordinance high water mark of the Lake from 75 feet to 50 feet; 2. Reduce drainfield distance from the property line from 10 feet to 5 feet; 3. Reduce interceptor drain distance from the drainfield from 15 feet to 10 feet; 4. Reduce interceptor drain depth below lowest trench from 4 feet to 2.5 feet; 5. Reduce septic tank distance to a structure from 10 feet to 5 feet; 6. Reduce septic tank distance to property line from 10 feet to 5 feet; and 7. Reduce tank size from two 1,000 gallon tanks to a single 1,500 gallon tank. The hardship justifying the granting of the above variances are the size of the lot and the proximity to the Lake. The above variances are granted subject to the following conditions: 1. Low water usage appliances must be used in the home; 2. A tank exchange system must be used for water softening; and 3. It is understood and agreed by the Applicant that the City offers no assurances regarding the workability of the new system requested by the Applicant. ``11 Adopted by the City Council of the City of Medina this / % day of .1.) 6 Pry ia; 1990.
