AN ORDINANCE, making an appropriation of Eight Million Dollars
($8,000,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer construction
in WW-2 and WW-3 Warson Woods Sanitary Relief (12302) in the Cities of Glendale, Rock Hill,
Warson Woods, Ladue and Kirkwood, Missouri; and authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into Contract
No. 53002 with Fred M. Luth & Sons, Inc. for sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Thirteen Million Three
Hundred One Thousand Eight Hundred Thirty-One Dollars ($13,301,831.00) and the allowance
for construction change orders and other project expenses is One Million One Hundred Ninety-
Eight Thousand One Hundred Sixty-Nine Dollars ($1,198,169.00);
WHEREAS, a supplemental appropriation request is planned for Fiscal Year 2025
(FY25) for a total appropriation amount of Fourteen Million Five Hundred Thousand Dollars
($14,500,000.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Eight Million Dollars ($8,000,000.00) is hereby
appropriated from the Sanitary Replacement Fund for sanitary sewer construction in WW-2 and
WW-3 Warson Woods Sanitary Relief (12302) in the Cities of Glendale, Rock Hill, Warson
Woods, Ladue and Kirkwood, Missouri; said contract being comprised of such terms and
conditions as have been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 53002
with Fred M. Luth & Sons, Inc. as the lowest responsible bidder for sanitary sewer construction in
WW-2 and WW-3 Warson Woods Sanitary Relief (12302) in the Cities of Glendale, Rock Hill,
Warson Woods, Ladue and Kirkwood, Missouri, pursuant to bids received on the 30th day of June,
2023.
The foregoing Ordinance was adopted September 14, 2023.
