AN ORDINANCE, making an appropriation of Five Million Six Hundred Fifty
Thousand Dollars ($5,650,000.00) from the Sanitary Replacement Fund to be used for sanitary
sewer construction in Upper Baden Sanitary Relief (Jennings Station Rd to Oakridge Blvd)
(12241) in the Cities of Northwoods and Pine Lawn, Missouri; and authorizing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter
into Contract No. 53003 with Fred M. Luth & Sons, Inc. for sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Five Million Thirty-
Three Thousand Three Hundred Fifty Dollars ($5,033,350.00) and the allowance for construction
change orders and other project expenses is Six Hundred Sixteen Thousand Six Hundred Fifty
Dollars ($616,650.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Five Million Six Hundred Fifty Thousand Dollars
($5,650,000.00) is hereby appropriated from the Sanitary Replacement Fund for sanitary sewer
construction in Upper Baden Sanitary Relief (Jennings Station Rd to Oakridge Blvd) (12241) in
the Cities of Northwoods and Pine Lawn, Missouri; said contract being comprised of such terms
and conditions as have been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 53003
with Fred M. Luth & Sons, Inc., as the lowest responsible bidder for sanitary sewer construction
in Upper Baden Sanitary Relief (Jennings Station Rd to Oakridge Blvd) (12241) in the Cities of
Northwoods and Pine Lawns, Missouri, pursuant to bids received on the 11th day of July, 2023.
The foregoing Ordinance was adopted September 14, 2023.
